Other than negotiating the artist's cut of the profits (10 points?), what else is negotiated during a bidding war? Beyond the usual A&R flunky, does anyone know who is really calling the shots during a bidding war?

I was thinking of the Smashing Pumpkins (pre-Siamese Dream) and I couldn't think of an answer.

I'm answering this because I'm a HUGE Smashing Pumpkins (& Zwan) fan. I think that the band's manager is really calling the shots. I mean he would probably go through all of the deals thrown at him with a music lawyer and decide on which deal benefits the band the most. That's just my humble guess though.

The advance; the choice of producer; the recording studio; the all-in; the royalties; the packaging fees; the reserve; the rights to the masters; the best efforts clause; the length and number of album cycles; the indemnities; foreign rights; tour support; and your mother.

Lawyers call the shots.
