Much anal-ysis is possible, yadda yadda yadda....bottom line:
AFC #1 versus NFC #1, the entire season both teams have been the team to beat, and now it's down to this.

Let me just post a photograph that will answer this question - please forgive the mis-dating on it, this was written by Glenn from Bass Specialties, in the midst of a night of MANY beers, with Greg from Rocket Music as a witness, and primary instigator (also, thankfully with a couch that my drunk @$$ could sleep on afterward). I believe THIS will let everyone know where I have been all season - this is not dated on the napkin, but there are two reliable witnesses as to the simple fact that this was written the second week of the preseason  :

Pitbull, nothing "official" in the works yet...gotta be careful with that stuff, you know how the NFL deals with people that mis-appropriate their trademarked logos and such...I'm worried that they'll be coming after Roscoe Guitars, Inc. soon over the "black gold" finish we offer.

I hope those responsible are terminated with extreme prejudice for both being total morons and for not doing their due diligence that is part and parcel of being a corporate lawyer. Fact: the phrase "Who Dat!" was trademarked in 1983 by Who Dat, Inc., a New Orleans based company. How do you trademark another company's trademarked property?

So, if the phrase has been used by everybody and there was no action by the owner to stop it, then they lose the trademark. Xerox had a big campaign to get people to stop using the term Xerox when they wanted a copy of something. I believe the term "Aspirin" was once trademarked too. Now it's just a generic term.
So, not defending the NFL, but they may have researched and found that the term was up for grabs. |
