Usually before an artist uses another artist work they contact the company that the artist song is registered with ascap,bmi,sesac,etc or they get in touch with the artist directly and if a % for the usage of the artist song can't be worked out or the artist doesn't want his/her wok used then it can't be used.


one of the first two hip hop/rap artist to be sued for using an artist music with out permission were Sugar Hill gang by Bernard Edwards and Nile Rogers(of Chic)for using music from the song Good Times and Slick Rick for using music from the song Joy and pain by R&B icon Franky Beverly(of Maze featuring Franky Beverly),these two cases set off an avalanche of Rappers having to get permission from the copyright owners of the song(s)they wanted to use,in the case of the SWV track called Rain,the producer Brian A.Morgan outright did what he wanted to do with Portrait of Tracy and he got caught up and had to pay and in the process having to pay more than if he would have simply asked for permission and if given the OK a deal on %'s off the use of the song would have been properly made.

The very first time I heard the song over a year ago, I said that was "Portrait of Tracy" and everybody looked at me like I was crazy. It was easy for me since that is a very familiar melody and a historical bass composition. Chingy might have fooled SWV, but not everyone. I'm glad the Pastorius were able to get compensation for the track. A local JazFunk band here named Detour remade the song "Rain" as an instrumental and give credit to Jaco and Brian Alexander as writers. The song is ironically published under 'A Stolen People's Music/Pastorius Music' which is Administered by Jaco Pastorius, Inc./ASCAP

That's right! Adding/removing/changing that one note makes all the difference. Wow, I never realized what a great songwriter ol' Vanilla was!
Reminds me of an Avril Lavigne interview I read once. She was talking about how it's "so mean when people say I don't write my own songs. "
So they interviewed her *ahem* songwriter. They did make it known, though, that AV was in fact a really great songwriter. In one song she changed the word "they" to "we" and "it just made all the difference in the world. She's such a talented person!"

this is from my earlier post.

the Portrait of Tracy part was the actual song lifted from the original track but mixed very low in the recording,you kind of had to be familiar with the track to recognize that it was portrait of Tracy by Jaco Pastorius lurking in the background.
Edited for a couple of misspelled words.
