Myspace and Cover Songs

Almost every cover band in our area has a handful of recordings on their myspace page of songs they do. They range from crude live recordings to some pretty decent "studio" renderings of classic songs.

What is your take on this? I feel like it has to cross the explicit copyright line in the Myspace terms. Others I have talked think it is OK in the context and no harm is done. Kind of like all the little kids strumming their guitars on Youtube. So is this a gray area or is it the another potential fight for the record companies and publishing firms?

Thanks for the link. The issue runs about like I thought it would. Sounds like you might be able to ride in the gray area for a bit with the slight protection of not allowing downloads. My guess is they will eventually have to address this more explicitly to the users, as I can't imagine Myspace ponying up sufficient fees to ge the kids of freedom we get in playing cover tunes in bars.

I also have noticed that some bands simply post the title as "live at XYZ Bar" rather than a tune name. Probably makes it a little harder to police that way.

I'm also a little intrigued by the fact that almost all of the bars around here require an "audition" CD of a sampling of playing. I guess I don't understand how you can get around the fact that you are recording cover tunes and handing them out. Maybe you can specifically address the copyright holder issue on the CD label.

I'd rather just post some of our originals, but that will probably limit our gig opportunities, since most places want cover bands.
