He got a great deal on a used one cause it was in the 700 to 800mhz range. It tops out at 805.079. I know he is going to try to use use it. What is the real world chance he will get caught and what happens if he does?

There's more to it than getting caught. There's potential harm it causes, which is why those freqs were reserved instead of shared. Don't be a douchebag.

RF bands are being more and more controlled because the available bandwiths are getting crowded.
As for the seller, if he clearly stated the illegal frequency band the unit uses, I don't think any law would restrict him from selling his/hers own unit. The cheap price is often an indication as well. I'm no lawyer though, nor do I know the exact RF laws in Your state.
On remote areas You'll get by, as the operating ranges are rather limited, often less than 200m.

I wouldn't have felt right selling somebody something that is illegal! That seller was wrong. I'd be asking for my money back!
Wondering, exactly 'what' make and model unit it is? If it can successfully be set to operate on that 800mhz frequency, it may work fine. I have a unit that has switchable frequencies. |
