Advice re breach of contract with major label
Am grasping at straws here, but bear with me.
My significant other recently entered a national song composition competition and made it to the final stage before being knocked out. Before entering the final stages she signed a mandatory contract with a major US based label (we're in Europe), one clause stated that she must never have released the song commercially. Rights to the song belong to the record label until the end of this year.
She was aggressively contacted re breach of contract last night - it turns out she played the song live at a charity gig some years back, it was recorded by a third party and make available for sale on iTunes.
So...any advice on what to do here or what potentially might happen? We have no legal background. Any advice appreciated.
