The Bassplayer - Sydney Australia - Out of business - stories

UPDATED - Bass Straight Pty Ltd trading as the Bassplayer has now gone out of business and will be placed into liquidation. Musicians are going to lose money because of this.

Okay, well I have held off on posting about this for about 6 months, but I have decided that I have done all I can reasonably do to progress this situation and so I thought I would post this to serve as a warning to anyone out there thinking of dealing with The Bass Player in Sydney Australia.

My Story

In February 2006, before I left Australia to live in the UK, I placed 4 items of bass guitar related gear on consignment with Bass Straight Pty Ltd trading as The Bass Player. These items were listed on a Department of Fair Trading form / contract outlingin that there will be a 20% consignment fee and a deduction of $38.50 for a 5 string bass as a service fee. The funds were due to me withint 14 days of sale. The goods were (all in Australian dollars):

1. Warwick Amp - sale price $1400
2. MTD Bass Guitar - sale price $1000
3. Warwick Speaker - sale price $700
4. Aguilar Preamp - sale price $250

In late 2006 I contacted the Bass Player and was told that the speaker and the preamp were sold. They said they would notify me when everything was sold. I contacted them again in January and was told everything but the Warwick Amp was sold. I asked whether they could send me the funds for the 3 items that were sold and gave them my bank details. The funds were not sent. I made a number of emails and phone calls requesting that the funds be paid to me and, although no emails were every answered, each time on the phone it was confirmed that the funds would be paid shortly and they were never paid.

On 12 March 2007 I sent a letter of demand via both fax and email and received no response. Immediately prior to sending the letter a friend of mine (and fellow TB'er) in Sydney collected the Warwick Amp from their possession so that at the time of receiveing the letter none of my goods were on consignment.

After receiving no response (and trying to find a solicitor in NSW to assist), on 20 June a complaint was lodged with the Office of Fair Trading. The OFT contacted Janet Linbom of the Bass PLayer who advised Ms Floyd that the amount was owing and that payment would be made by Friday 6 July. Payment was not received.

A subsequent request of mine to Ms Floyd to try and contact the Bassplayer again to follow up on why payment wasnt made was unsuccessful.

Quotes from the emails from the OFT:

Unfortunately, all further attempts to contact the trader on your behalf have been unsuccessful.
I have now lodged a claim with the Consumer Tribunal in Australia to recover the money, but I feel that even this will probably be ignored by the Bass Player.

In summary, since no later than March 2007, they have owed me around $AUS 1500 under a contract which stated payment would be made within 14 days. They have not responded to my emails, returned my phone calls or paid me the money oweing. I have expended a considerable amount of my time in following this up and have now lodged a complaint with a Tribunal in Australia which will take up more of my time.

What you can do to help?

If you feel that what the BassPlayer has done is unaccpetable behaviour and you would not be prepared to use their services because of it. I would strongly encourage you to let the Bass Player know.

The Bass Player is owned by Karl and Janet Lindbom.

Email them at:

info@bassplayer.com.au

On myspace:

Telephone or shop address:

Bass Straight Pty Ltd T/a the Bass Plaer
29-31 Paramatta Road
Annandale
NSW 2038
Australia

Phone: +61 2 9550 4048

I would also encourage you, if you live in AUstralia, to let your fellow bassplayers know about this incident and why you should be careful dealing with them as they have not honoured their contractual obligations.

What should I NOT do to help

Please do not contact them to make threats or demands on my behalf. I am pursuing this matter legally through a Tribunal and do not want the store to receive any threats or demands from people. I am happy if people mention that they are aware that they owe me money and because of this they will not use their store and encourage others not to do so, but please DO NOT make any demands or threats to them on my behalf.

Reason for this thread

The reason for this thread is to let people know about my experience with the store and to recommend that people do not take their business there. If you agree, I am happy for you to let them know this.

If anyone else has experiences with the Bass Player or has an contacts with the store that could help me out it would be greatly appreciated. I will keep my fellow TB'ers updated on the progress of this matter.

I should also note that part of me, call it my gut instinct, thinks that perhaps the Bass Player is about to go out of business / insolvent. That would certainly explain why they havent be able to pay the money to me - although it doesn't excuse it. If anyone is located in Sydney and goes into the Bass Player could they post and let me know if its still open and whether or not it seems to be going out of business.

Cheers

Mark

Sorry to hear of your troubles with these people. Hope you get your cash and they go out of biz afterward.

That sucks dude, I hope they come through... Tried to send them an email although it came back as undeliverable

Gave the store a call for you and it looks like they are still in business, someone answered the phone within two rings.

Have you managed to get a lawyer involved yet? All it may take is getting one to walk in there and lay it out for them and you'll probably get your money. I did the same thing to a mechanics that tried to shaft me once...

I am a lawyer!

THe problem is they know I am in the UK. However, they will get a shock when they get their summons to appear at the Tribunal in a week or too.

Wow. I was planning on going there this week to see if they had any amps I wanted.

I'll see how business is, but I doubt I'll get anything from them after hearing that.

Mark I drive by there regularly, but at night when they're not open. Either way, there doesn't seem to be any sign at this stage that they are out of business.

Oh and your amp is still safe & sound at my place. I've been flat chat doing 5-6 gigs a week + working + a million other things. When I get a chance to stop and scratch myself, I'll do something about sending it on. Sorry man, I feel like a total slacker.....

Cool thanks for the update.

No stress about the amp! I feel a lot safe with it in your possession than theirs!

I feel for you man, In the early 80's I moved and put a ric and a couple of Acoustic amps into a Brisbane establishment and I kept phoning them and they kept telling me the gear wasn't sold yeat even though I'd put fairly low prices on them. Eventually I got a mate to go check them out and sure enough they were sold. I chased them for money for months, until they did go out of business.

Feel for you man. Many dodgy business people will wait till they get to the fair trading tribunal before doing something about it. Having you in England probably makes them less interested.
I just got my tax cheque and can finaly afford a bass of substance. I guess that is one place I won't be looking at.

That is seriously average. What i don't understand is that it is word seems to travel pretty fast in the music industry - do they seriously think that you wont tell people? That people like us wont find out and then tell the people we know off the forum? Not a very clever business move...

I have used the bass centre in Melbourne to sell goods before and found them to be excellent both in terms of realistic pricing and paying up. I would definitely recommend them.

I would NEVER recommend the Bass Player in Sydney

This is very disappointing. I've been a customer of the Bass Player is Sydney for many years now, I've even sold goods on consignment there, and I've not had a bad experience yet.

I came to be a customer in the first place because it was the only place in Sydney where I could try out a large number of brands in the one place. It used to be a case of going to one store to try Brand A basses, then going to another across town to another store to try a Brand B, and so on...... until eventually you forgot what the first few basses sounded like and felt like you had to start again. It was very frustrating.......

Then Karl opened the Bass Player and that all changed. Over the years I bought lots of stuff there, then sold some, giving Karl and former employee Lincoln the opportunity to get to know me.

And then this happens...... what a bummer. Luckily I'm not in the market for any gear right now because I'd be facing a dilemma. I don't fancy the thought of driving all over town again to find something I like. I honestly wouldn't be able to find the time. But I also think the Bass Player has done a very bad thing to Mark. If only Sydney had an alternative specialist bass store.........

Walked past the store last saturday - they were definitely still open.

Savages. After behaving like this, they deserve to go out of business.

This really p*sses me off. A mate of mine(guitarist) was after a cheap bass at different store. They didn't have the one he wanted so he ordered it in - paying a deposit. They told him it would be a couple of weeks. He gives them two and a half, then calls. No bass - 1 more week. A week later, the same - 1 more week. The same deal the next week. Fed up, he walked into the store and bought another bass, transfering his deposit over to said bass. The next week(honestly) the store was closed for good.
Surely they would have known that they were closing, yet they never told him anything. Do you think he would have seen his deposit(or ordered bass) ever again? I'm glad that he got hs money back, but I'm not happy that they got his business.

Anyway, I hope it all works out for you Mark. Hope you get all your money, and I hope justice is served.

What a bad career move by BassPlayer to pull such a dodgy deal just as every bassist's tax-return money is begging to be spent.

I'll join the boycott.

I thought I was the only one!

I'm checking out greensquare.net, but guarantee or not, I don't like the idea of buying equipment without ever having tested it. And I really don't like wasting a store's time/money by ordering equipment just to test it and send it back multiple times.

Considering putting a Melbourne visit into the budget to play at the Centre...

bass player is for sale.it has been for over a year i think. definately not what it used to be by any means. the store is still open but i get the vibe whenever i have walked in there that they dont care. to get anything you need to pay up front and i would say that more than half the stock that they have in there is second hand. not really the place that i would want to go to spend my hard earned cash. its a shame. sydney needs a new bass destination. good luck with it mark

Seeing you're in Sydney, give David Burgess a call anyway. He's a reasonable person who'll probably be happy arrange a way for you to try out some gear.
