Do you consider electric bass a "band" instrument? Two of my friends and I are looking for an apartment and in one of the lease contracts it states that no band instruments are to be played at any time. One of my friends plays saxophone and I can see how this would be problem for him but would bass be affected? On my rig I have a headphones plug.

Sounds to me like your looking for a technicality to get you out of trouble when the neighbours start to complain.
If you use the headphones then no harm done. If you want to use your amp I'd probably look for a new place. Your landlord isn't going to be around 24/7 looking for breaches of contract you should be able to bring the instrument in when he's not around no problem. If your not playing it your not breaking the terms of your contract. If you stick with the headphones then I don't believe your going to get kicked out

Even if you never bother anyone, if the landlord knows you even OWN a bass, (s)he can try to use that clause to try to screw you out of your deposit when you leave. Particularly if you're a poor college student.

| | | I'd say yes, I think they would consider it a "band" instrument.
In fact, my old high school orchestra actually had a guy playing electric bass guitar from time to time. |

I mean, I've seen high school bands with an electric bass, not just combos or rock bands.
Be respectful of your neighbors and play with headphones. If no one complains, you won't have any problems. Don't be the jerk who's playing loud at 11 PM when everyone's trying to sleep.
Oh, and you probably don't want to flaunt your instrument anyway. Don't want to give anyone a reason to try and break into your apartment to "find" something to sell to the local pawn shop.

My friends and I are looking at another place since the friend who plays sax is raging p*ssed.
Thanks for your input.

just one question that you should ask said landlord: what instrument(s) are not 'band' instruments?
