The guy who altered this photo was apparaently a DK fan, as you can see the logo on the wall behind Oswald. According to one source the photoshopper is the guy with mustache in the back left.

The first one, as you posted, with the controversial "pie" was replaced with an American flag in the pie due to complaints and then the third cover was a complete pie without a slice taken out.
