I was thinking the same thing.

Actually, anything you make has an implied copyright, whether you put the (C) on it or not.

If it was just the bass clef I'd say it was a symbol that's in the public domain, but with the "Got Bass?" added, Paul may have a case.

Although the got milk? ad seems to be the first, and I don't know if they thought to copyright it.
The got * ? catch phrase has become somewhat iconic in advertising everybody's wares and ideas.
We shouldn't really be so shocked at all this.
