(edit> ripped OFF OFF)Kukaburra childrens song(sorry if i mis-spelled Kookaburra i'd have to go back and i'm at work so have to be quick)

just read a blurb MAWork are being sued because the flute riff in`land down under/`83 megahit was allegedly hijacked from a popular childrens/campfire song and even tho' the person who wrote the childrens song for whatever reason before her death never brought litigation against MAW,,,,,,,,,,they get sued for millions NOW

i listened to both(yes do a search `men at work'it's on the web),,i didn't hear it and the kids in the video were singing not fluting so(i'm guessing) nobody could utilise the same written musical notes and create anything new or how DOES that work

yeah but it's def. a stretch,,a good stout ale on a friday night is'nt making my head any clearer(thankully/i needed one) but what gets to me is even if notes are `written' yet played to a dif. time,well i guess all the old bluesmen truly got screwed since they`must be' the originators of 1000's of songs

all we(they) have to do is figure out who originated what and sue them,us,we

i can definatley understand a blatant`cover' but`marking time' and(a recording co. sueing 30 years later even when the originator of the lick never said squat)i ah?,,,,well thanks for the replys,hope i don't put any of my TRASH to paper might get sued or maybe my grandkids will get sued by Bukka White's greatgreatgreatgreat(can i stop?grandbabys)

I have heard both songs countless times, and the comparison is so weak I can't believe any court would even take the case.

Unfortunately many court systems in the world allow lawsuits against anyone for any alleged reason.. win or loose the bill is normally ours.

I think the Kookaburra song is an onomatopoeia of the actual song of the kookaburra. The flute part in the men at work song seems to have the same quality to it as well.

I think the composers of both melodies owe the kookaburra a million dollars, or maybe some seeds and nuts or whatever the hell a kookaburra eats.....

Some sounds become iconic. Clearly, the MAW song is an ode to where they come from, and the kookabura reference by the flute is a component of that.

For an American example, let us look at how many different ways that the whistle riff from The Good, The Bad and The Ugly comes up in commercials and songs (most notably for me in Joe Jackson's "Wild West").

Gotta admit that I don't think the similarity is close enough to justify the suit, much less MAW losing to those bringing on the suit. How sad.

Never mind the fact the song was around eons before my own birth; I plan on getting a REALLY good lawyer.

You'd be too late - that song was written by two old ladies from (I believe) new england, and they get royalties every time that song is played on TV, in movies, the radio, etc...

edit - turns out those royalties are about $700 bucks a pop. Nice. It also turns out they're dead, and now the company that owns the copyright gets that money.

+1 for truth.

most shows just use "for he's a jolly good fellow" since it's public domain.

read about the men at work suit. i hope they have the opportunity to appeal the case, but i have no idea how the australian court system works. (...or, really, the american one, either, for that matter. )
