Abandoned Bike?

Someone left a pretty nice bicycle locked up to a bus stop sign post outside our apartment. I watched him do it and it was on Friday night. He was walking with it and it squeaked a bit. I was wondering what anyones thoughts where on me cutting the lock off of it and claiming it for my own. What kind of remorse should I feel for such an act

I'm inclined to think that it isn't abandoned because it is locked up. In a few more days I may change my mind. I was thinking about taking a photo of it and posting it on craigslist lost and found. Something to the effect of "Is this your bike? If so come get it of my lawn or it becomes mine then"

Fair warning enough or should I just leave it alone?

I would think that since it's locked, I certainly don't believe it should be considered "up for grabs".

If I see something with a lock on it, to me it means that its someones property. If I decide to cut the lock and take the property, I just comitted a crime which is punishable by law.

If it bothers you that this bike is locked up, call your apartment management company and let them remove it for you.

It seems to me that if you cut the lock off, and take the bike, it's stealing. However, being that the bike is locked up on private property without permission from the property owner (I'm assuming), there may be some other issues involved that would allow for removing the bike. Since you are not the property owner (again I'm assuming), I would guess that you wouldn't have the authority to remove the bike even if it was lawful to do so.

(Disclaimer - I'm a lawyer, so don't blame me if I'm wrong.)

He could have gone out partying on Friday. Hooked up with a chick, had a weekend playing Sex Olympics and hasn't woken up from recovering yet. Give it a few days. After a few more days, you can figure that he forgot where he put it. It happens

Maybe the sign post is his and he locked it to the bike so no one would steal the sign

Actually, he just owns the lock. By adding the bike and the sign, it makes the lock harder to conceal (and steal).

Ridiculous. A lock obviously shows intent of keeping it. If it were the other hand, and had a sign on it that said "take me", I could understand where you're coming from. But not any other way.

Besides, it's not locked on your private property or anything. It's locked in front of your apartment. Are you just tired of looking at it or something?

Temptation is understandable. We've all felt it. But that bike is not abandoned, it's locked.

However, the test is simple: Do you own it at present?

If Yes, you can take it.

If No, then taking it is theft. Period.

Do you want to be a criminal for the value of a lousy bike?

The guy who lives next door left a pretty nice looking wife at home. I watched him leave this morning. He was walking away from her and his shoes squeaked a bit. I was wondering what anyones thoughts where on me breaking into his house and claiming her for my own. What kind of remorse should I feel for such an act?

If it's really bothering you that much, let the landlord know. He or she probably doesn't appreciate someone using their lawn as a free bike parking space. The city probably has laws against stuff being chained to their signs, too.

I'm not doubting the quality of Ambercrombie and Fitch undergarments, but I understand your dillema.

Here's what I would do, if'n I were in your shoes:

Marinate it in a solution of 50% balsamic vinegar, 20% soy sauce, 2% olive oil, 23% orange juice and another 11% soy sauce. I know that comes out to more than 100%- but that's not your problem. You want to sear it first- so use a high flame for about and hour and a half- then back the heat down to around 25%. Keep it that way for around 3 hours- take it off the heat- let it rest. Restring it with D'Addario XL160s and be on with it.

Should just about wrap things up for you.
