If it is true, I feel for the kid. Overnight he went from a nobody to having sex flung at him. The bummer is that Jr already had a girlfriend who was cute and had a career to protect too. When you are famous, nobodies offering quick sex should be a red flag.

She gets a private paternity test done, if it comes up positive she will get a nice big lump sum of hush money and sign a disclosure stating it never happened.

The laws vary somewhat from state to state, so I don't know if any apply here. In most states there is an absolute age-of-consent, typically around 16-18, but there's also a clause that there needs to be a certain number of years of age gap between the two - otherwise you'd have statutory rape when an 18-year-old slept with a 17-year-old the day before the latter's birthday, which hardly seems logical. It may or may not be the case that in the state where the encounter allegedly happened a 20-year-old sleeping with a 16-year-old counts.

She lives in the little town where I grew up. Anyway, he's talking about suing her (which he should) and taking a paternity test (which he should ... if there's no chance she's right). The DA is probably going to charge her with statutory rape. The age of consent in California is 18.

That's what I was referencing earlier. In some (a lot) as long as the party is consenting, a 16 year old can have sex with a 20 year old.

I suspect your wrong on this one. While a 19 year old and a 17 year old may be able to escape statutory rape laws in some states, I can't imagine any state where a 20 year old having sex with a 16 year old would not be considered statutory rape. A few states have three year age difference exceptions, but none have four year exceptions to my knowledge.

I also suspect that paternity won't apply in a statutory rape case. The whole premise of statutory rape is that the victim is being "taken advantage" of, and therefore not able to consent. The only out she may have is the courts tend to look a little less severely on male "victims" than female victims. If this was a female pop star at 16 suing a groupie for paternity who was twenty, I suspect he would be looking at serious jail time.

I was under the impression that in the states with laws pinning 16 as the age of consent, a 16 year old could have sex with any adult they wanted. I could be giving age of consent laws more worth than they deserve.

16 year old boy had sex with a 20 year old woman. Shame on him, he should have known better!
