In most states there is an absolute age-of-consent, typically around 16-18, but there's also a clause that there needs to be a certain number of years of age gap between the two - otherwise you'd have statutory rape when an 18-year-old slept with a 17-year-old the day before the latter's birthday, which hardly seems logical. It may or may not be the case that in the state where the encounter allegedly happened a 20-year-old sleeping with a 16-year-old counts.

While a 19 year old and a 17 year old may be able to escape statutory rape laws in some states, I can't imagine any state where a 20 year old having sex with a 16 year old would not be considered statutory rape. I also suspect that paternity won't apply in a statutory rape case. The whole premise of statutory rape is that the victim is being "taken advantage" of, and therefore not able to consent. The only out she may have is the courts tend to look a little less severely on male "victims" than female victims. If this was a female pop star at 16 suing a groupie for paternity who was twenty, I suspect he would be looking at serious jail time.

I could be giving age of consent laws more worth than they deserve.
