I think you sign waivers for photoshoots like that. Most of the time they say stuff like how the images resulting from the shoot are property of *enter magazine or publishing company here* to use in any manner they see fit.

I think it's wrong, but unless she was wise enough to retain rights to those images, she will just have to roll with it, or start an informational campaign about the real story behind those photos.

Despite getting waivers for usage, a magazine does not have the right to misrepresent an individual.

Question is whether making a celeb naked is misrepresentation. Im sure her lawyers could prove so (while she enjoys the extra news coverage).

They're just doing this for publicity. So what, they have to pay ciarra a few million or whatever it is, but they get LOADS of FREE advertising.

I looked inside that issue, and I think the photos clearly show a thong. I think Ciarra is just getting some extra buzz. It can't hurt since CD sales are so flat.
