Ebay Rights; seller refuses to ship

I just won an auction for a warwick fortress one on ebay at a nice low price of 499 plus 40 shipping. The seller then refused to ship the bass and refunded my payment when I asked for the tracking number so I could ensure that I would be at the location at that day, I explained that my parents had gone through a divorce and I live in both locations at this time and I just wanted to make sure that I would be at that specific house the day it arrived. The seller still refused to sell me the bass and refunded the payment. Am I entitled to the bass still for the price I won the auction for, just because the seller doesnt want to give up the bass now (possibly because it sold for lower than wanted)... I just want to know if I have the right ( and will do so) to report the seller for refusing the auction... any advice is welcome, thanks

call ebay - make sure u can prove u won the bass for that price and that you payed within a timely fashion

sometimes its just too good to be true

Call ebay. They can't force him to send the bass, but they can revoke his membership for breaching their rules.

Did they require it be shipped to a verified address?

I wouldn't ship it to you either if your address didn't match your Paypal account.

That's one of my protection measures for Ebay.

Are we hearing the ENTIRE story here or what?

Yeah, I think you can forget the bass. But at least if you get the idiot booted off ebay you'll be doing other people a favour. Talk about unethical - clearly some people don't understand the fairly simple concept of an auction, or a reserve price...

Good point about the addresses, though. Can't be too careful with that stuff these days.

Methinks there is more to this story than just some dude not wanting to ship a bass.

Maybe. The OP did imply that the seller had already had payment, though. I agree there COULD be more to this than meets the eye - let's see.

But he also mentioned he may need it shipped to a different address being between two houses.

As bad as Ebay is I don't know if I would ship either.

No - you read the OP wrong. He said he wanted the tracking number so he knew when it would arrive, because he lives at both of his parent's houses - he wants to make sure he is at the right house when it arrives, rather than being stuck somewhere else and not being able to get his hands on it as soon as it is delivered.

Yes I stated that I needed it because I live at both and when he said no i also said fine theres at least a 50% chance i will be home if he doesnt give it to me and that certaintly is better than not shipping it, the address is a paypal/ebay verified address, it was needed for the auction it wouldnt of even let me bid if it wasnt. The only reason I can think of him not to ship it is the fact that i was the only person to bid on it and it did not sell for as much as he liked sincehow it was a fortress one selling for under $500.

sorry bassybill its late... or rather early here (630am) and i haven't slept yet so im a bit off kilter I just want the bass, I won it fair and square, but I am doubting its arrival.

welllll..... i doubt eithers going to happen unless ebay really puts its foot down and scares this seller I really doubt ill get the bass but even so it would be number 6 and still haven't found the "right one" I just suffer from terrible terrible GAS

You really don't need to give anyone a story when asking for a tracking number. Just ask for it. You may have given him too much information.

at least he refunded your money!

If I were a seller I'd be wary of a situation like that (Lousy scammers ruining for everyone). I only ship to verified addresses. YOu should have just asked for tracking and thats it

ahh well. Maybe you can work a deal out with him off-ebay.
