Here is the story, I worked the summer for a small construction company and when I was done at the end of the summer they still owed me all of my vacation pay and my record of employment, I am supposed to have this within 7 business days BY LAW. Then just before Christmas my new employer lays me off. So to be able to collect unemployment pay (mooching off the government) I have to have my record of employment from everyone that I have worked for in the last 4 months, still includes the guy I worked for in the summer. Thing is, they still haven't given me my record of employment.
So I phone them up and tell them that they owe me money and my record of employment. They said that they would get it to me within the week. This was before Christmas. Fast-forward to today, I still don't have my money or my ROE, so I went to pay the owners wife a little visit (she is their bookkeeper), I tell her that they have until next Friday to get me what they owe me or I am calling the Labour board to report them. She aparently wasn't too happy about this and called her husband (the owner) who then called me and yelled at me for talking to his wife and not him. Now you have to understand, this guy was a pain to work for at time. You would hand in your hours, then on payday he would come up to you and say that he lost your hours so there isn't a paycheque for you. This happened all the time. So I wasn't about to talk to him about it, because he would have just forgot.
I ended up telling him that he has until Friday to get me the stuff, or he is being reported. He then blames me for not reminding him. Sorry, but that isn't my problem. You have to have that stuff to me BY LAW withing 7 business days.
Anyone know what I can do beyond reporting him if I don't get the stuff? Beyond breaking his knees (he is a big guy, I wouldn't stand a chance)?

In the USA, the unemployment office has the ability to gather that info electronically. Perhaps Canada should step up their technology to the 2000's.

Your former employer knows nothing is really going to happen on Friday, so he doesn't care. To him, it's an idle threat that you'll just keep extending and extending because you're ultimately afraid to report him and get him in trouble. He knows you're going to need a job later down the road, and if you report him, he will never hire you back.
A phone call from your labour office will get you the report you want much faster than you saying "if you don't do this by then, I'm going to.....".

-Mike | Well all of that can be collected electronically, but you have to have a 5 number "pin" number that you have to submit on the website and that comes on the ROE. You have to do that before your two week waiting period starts (you have to wait two weeks before you start getting unemployment, so you get your first cheque one month after getting laid off).
I would report him right now, but I gave him my word that I wouldn't until next Friday. I like to keep my word.
Anything I can do beyond reporting him? Also, another ex employee of his had this same problem.

till next Friday to report him. But IMHO it's safe to assume you won't get results by then.
How did the other ex employee handle the situation?

-Mike | He knows I will do it. I would never go work for him again, too much of a hassle. I have a good job now, just got slow for a few months. I actually got hired back and had work all week, and I will all winter as well. So I don't really NEED my ROE, but I still want it.

The other ex employee just kept bugging him until he got it.
I also don't want to make him too mad at me, but it will probably take that, because he is a friend of my dads.

But the ol' fork-in-the-eye never fails.

Vaseline his windshield, then lay a few sheets of saran wrap over it. He gets into his car, wonders what happened to his windshield, initial reflex is to hit the wiper blades, and he's got one sticky slimy mess all over his wiper blades. |

Dump a whole bottle of Dawn on his windows...especially when it's cold. He'll try to wash it with wiper fluid but he'll have a sudsy mess on his hands...
