EXTORTION...is it really worth $50?

My town, like many these days, is having a budget crisis. However, our city auditor has apparently come up with a BRILLIANT idea for raising money.

2 weeks ago, I got a notice from the city income tax department stating that I still have not filed a 2008 city income tax return, and that I need to do so ASAP.

I went in and showed them the check stub from the refund check they had sent, plus my copy of my return, stamped with the time & date it was recieved.
You would think that this would clear up the misunderstanding, but no. "File it anyway," they said; "and pay this $50 late filing fee while you're at it."

Of course I didn't do it. Why should I? I filed on time. There is no problem with my return, they just say they dont have it in their computer system. Well that's not my fault, now, is it?

On Saturday, I got another notice; this one "reminding" me that I face arrest and/or a fine of up to $1,000 if I do not file my return.

So far, my mother and at least 2 coworkers have also gotten similar notices, despite having filed a return on time. They paid the $50 just to get it over with. Which, undoubtedly, is what the city is counting on; that people will pay the $50 without question if you threaten to arrest them.

I'm not paying.

Talk to a tax lawyer about what?
I filed my return.
They say they have no record of it.
I show them my return, stamped by them when it was filed, and the stub from the refund check.
They refuse to accept it and demand money instead, threatening to have me arrested if I don't pay.

I wouldn't pay it either. I would keep talking to people though, trying to get it straightened out.

It's amazing how these duds "work". In the midst of a budget crunch they have the luxury of raising taxes or adding "fees" onto everything. I wish I could do that. "Hey boss, times are tough. I'm going to add a fee onto my salary now."

Muni workers are bureaucrats. Make sure that you get things in writing to document your attempts at proving your taxes were paid.

If you like you want to get into it with them, and everything else that the city regulates because they will come after you, call a consumer advocate at a local media outlet and see if they think your story has merit (TV, radio, newspaper). It might make it all go away and then the next thing you know the trash inspector may have problems with your trash cans, and is that dog licensed, and what about the property setbacks, is your foundation safe, are they illegally stored musical instruments in your attic....

That was my first thought. Making the news would be almost guarantee the practice ends immediately.

Alert the media, contact a good attorney who might be interested in class action. It sounds like it's happening to alot of others as well. Local jails are not the same as the federal pen, you can hack a night or two.

Ha! My local library is also facing a big budget problem. They just re-billed me for a $30 fine I paid back in February! What a coincidence.

The school corporation tried billing me for my daughters book rental from THREE years ago . She's 19 years old now and hasn't been in the public school system for nearly two years. I called and told them I had paid previously and had receipts . They called back and said "sorry about that , forget about it "


The following is sketchy and not discussed much in my family.

My great grandfather had two farms.

Back in the early 1900's they , federal gov't , attempted to collect taxes on his income as he hadn't been required to pay them before. He told them to stick it and wouldn't pay .

My family hasn't farmed since that time.

They took everything he had.

Get it cleared up . You can't win without proper procedure.

I never heard of "CITY" income tax before?! What the hell is that? I only know of Federal and State Income Tax and local property tax.

I would pay fifty bucks for an extortion pedal as long as it doesn't require a 9volt.
