I am getting sued for being a hero

Sign in to disble this ad
Remember The Incredibles at the beginning of the movie, when Mr Incredible jumps to rescue a guy who is jumping off a building. Then the guy sues him because he didn't want to be rescued, instead he broke his neck and sues him.

Well something similar is happening to me...

I am driving, minding my own business, when I see a car ahead of me, swerves onto the side of the road, falls into a ditch (a swampy ditch).

I pull over, as well as other cars. Car is half way in the water.

Nobody is jumping in to rescue the woman who is trapped there.

The police comes, I am waiting for the guy to jump in or do something, he doesn't.

I take off my shoes and shirt, I jump in and break the window, I take the woman out of the car, and some people help me pull her out of the water.

Ambulance finally comes, like an hour later. They tell me I am a hero, and wonder why the police didn't help.

They tell me about how I will be all over the news.

A week later I receive a letter from a lawyer, which I thought was weird. The person I rescued is suing me for breaking her leg, although the paramedics told me she broke her leg on the accident.

Now I have to hire a lawyer to get me out of this mess.

I am done being a hero.

no good deed goes unpunished.

Lame - hopefully the judge that hears the case dismisses it without going through a whole lot of hassle.

Find out which hospital she went to... track down those paramedics to help you.

No judge in his/her right mind will take the plaintiff's side...this is total and absolute idiocy.

Countersue her for legal fees. This kind of stupidity infuriates me to no end.

This lawsuit will go nowhere. I can only guess that this slimy lawyer is hoping you'll get scared and pay money to settle.

Look up "good Samaritan law"
It protects people from lawsuits when they help a person in distress. Even if a rescuer injures a person (which you didn't, anyway) the law protects the rescuer from liability as long as he acts in good faith.

Unfortunately this kind of thing happens all the time. usually it's provoked by a money hungry lawyer talking their client into suing. Don't know if that's the case here, though. Could be she's just a jerk.

She should be truly ashamed of herself, the unfortunate thing is she probably won't feel anything

She's only one in many good people though, fair play for helping sir.

Does it?

The guy could have been wrong (or pos. only talking about the UK), but the instructor on my first aid course pointed out that, while people have tried to sue first responders or first aiders, none of the cases have held up (because of the already mentioned Good Samaritan laws).

Have to agree with this. Don't let anyone think you did anything short of the right thing.

You'll be covered by good samaritan laws. Counter-sue her for making a frivolous lawsuit! You should be able to recover court costs and attorney's fees plus some.

Should counter-sue for defamation of character.
