I don't know how, because I'm usually pretty careful with backups and stuff, but I managed to lose a couple of albums from my iTunes library. I emailed their support and asked if I could redownload them.
They managed to come up with the goods for one, but told me the other was now "unavailable". So, I asked for a refund. Yes, I'm aware of their policy on this, but thought I'd appeal to their goodwill as I've been a pretty regular customer of theirs for quite a while now.
No dice. So, no more orders from me. Just thought I'd let you know what sort of customer service levels they work to. I have to say I've seen better.

They "give" you (free of charge) the material they still have, You already know the refund policy,
Yet it's "refund or else" from you.

They did send him the album they still had.
Personally, I'd ask if they expect to have it again in the future, and to be noticed if it happens (or if it's better for me to send another inquiry at a better moment).

He's demanding another copy of it, or a refund,...or else. All while knowing before hand the policy and being given another copy of the material still available FREE!
I don't see how Itunes is even remotely in the wrong or unreasonable here. How can you?

What you're saying is the same as going to a CD store, telling them you lost your CD collection, and they give you new copies. But when they don't have one album, you want a refund because they don't have a copy of something you lost.
Consider it a $10 lesson and don't let it happen again.

Yes, iTunes Plus also offers this service but they're still using iTunes' mediocre ripping software. Amazon uses the industry-standard LAME 3.97 ripper. Like iamlowsound I'd still like the option of lossless though. eMusic is a great subscription service but there are still some things that aren't available there that ARE available at Amazon.

I had my external hard drive crash and I lost everything I had bought from iTunes. I sent them an email and they reset my downloads for everything they had available. It took the better part of a week to re download everything. Yeah, there was some stuff that was "unavailable", but the amount that was available was amazing.
I now back up my iTunes files to DVD and a separate external hard drive.

I did explain in the OP that I knew there was no obligation on their part and I was trying to appeal to them on the basis of goodwill. It didn't work, so they've lost mine. Perhaps that is unreasonable, but it's my money, right? Sticking to the letter of policies isn't always the best way to retain customers. Yay for Consumer Power.

I do back up stuff regularly (entire hard drives on all 4 of my PCs, using Ghost). Only trouble is, if you do manage to accidentally delete something without realising (Heaven only knows how I did this) and then continue your backup schedule as normal, obviously you can then easily end up backing up your data without the deleted files. That's what happened in this case - the two missing albums were bought quite some time back and I never noticed they were gone until yesterday.
Anyway, what with the DRM hassle, compressed format, high prices and bloated software (imo), I've been thinking that iTunes is pretty sucky for a while now. Perhaps they'll go the way of the dinosaurs in future - I dunno.
It's a completely different service, but I'm listening to a lot of stuff on Spotify nowadays. Do you get that in the US? I think Pandora may be the closest you got over there. I used to get that here but it's not available in the UK any longer. Spotify is pretty good, though, I have to say. http://www.spotify.com/en/
