Yes I really hate my bank. I went thru a similar process and they wouldn't even respond to a Lawyers document requests. They offered me three different trial modifications, all three telling me, that if I completed them I would likely qualify for a permanent modification for the same amount. In the first two I was given no reason why I didn't qualify. The third one which was made permanent after a 22 month process, saves me a whole $50 on my house payment. This will make a huge difference considering I've taken a 20K pay cut over the last two years.
The problem is two fold. First the administration introduced the program with no guidelines, then they added guide lines then they changed them again. The other problem is they now base what your final payment should be based on a percentage of gross income, which is worthless for a road salesman for someone who is self-employed. My gross wages are a good 50% higher than my net income after taxes and expenses. As far as I'm concerned Ally bank is a criminal enterprise, and the bureaucrats who set up the program should be doing time with them.
Please keep us up with this one.

Also, shame on all the scum sucking lawyers that refused to take the case because they said the bank would win due to their deep pockets!

If any other type of business tryed to pull the fees and rules the banks do for thier customers they would be shut down. For example, if you have a bank account and deposit a check and it bounces they charge you, if you go to thier bank and cash it there they still charge you if you do not have an acct there.
I get charged $5 for every gig check I cash. BS if you ask me.

-Mike | Sometimes you have to do the right thing regardless of if you win or lose. From the limited info in the article, this guy sounds like he very well could win this.

The Hacker News ~ Anonymous Hackers will Expose Something Awful About Bank Of America On Monday ! ~ The Hackers News Quote:
Last year Wikileaks' Julian Assange said he had documents on a major bank -- everyone kind of figured that it was Bank of America -- though it now seems that there isn't much to it.
Now Gawker's Adrien Chen points out that a member of the hacker group Anonymous going by the handle OperationLeaks on twitter is claiming to have damning docs on the bank that will likely be released Monday.
OperationLeaks has been teasing all day on twitter about having received documents on the bank from a disgruntled employee.
Chen's own sources within Anonymous suggest there's something real to the leaks.
In terms of substance, it's not clear what we might see. This tweet, regarding is the closest thing to anything explanatory: He Just told me he have GMAC emails showing BoA order to mix loan numbers to not match it's Documents.. to foreclose on Americans.. Shame
If something does go up Monday, it's likely to be at Anonleaks.ch.

-Mike | Talking to my Lawyer, the biggest issue is their is no case law history to go by. No one has ever sued these guys and the HAMP program (typical of the Government) is written in very non contractual language.
And the current guidelines are so poorly written, that the only people who really qualify are people whose mortgages were too much for them to afford under any circumstances. They are also written with absolutely no consideration for unconventional job situation. My expenses (all work related-lots of travel) are not even considered when they figure what you can "afford" in payments.
If you have a second mortgage that's not even factored in. Plus the actual number is high. The government program figures you can spend 31% of your gross income for your house payment. And they don't include any other bills in figuring your qualifying ability including a second mortgage. And the government pays the banks $1000 for every trial modification, but gives no additional help for permanent modification. The only incentive the government gives us adds up to $1000 per year toward your payments.
The TARP money just goes directly to the bank, and they are not required to pass any on to the consumer in the form of principle reduction. It is a total cluster put together by the clueless. And yes it's criminal, we gave them billions of dollars to cover their bad decisions, and they aren't willing to pass on a few thousand to help a consumer in the same home.
