If they had been totally heartless, they would have just killed the man so he could not identify them.
I will make some enemies if I say this, but the law does not have very good record of aplogizing when they get the wrong guy either, in fact they often spend big money trying to shoot down any appeal rather than admit a mistake.

By admitting liability they're almost certain to lose in court.
When I went for my induction for my work at the local council (I'm a bartender  ) one of the main things they taught us was no matter what happens we cannot say sorry to someone.
