Basically in Spain, a man in an audi hits a 17 year old bicyclist and kills him. The accident causes about 20,000 dollars worth of damage, the man sues the teen's family for the damages. Not only does he won't the money for the damage he wants the family to give him money to rent a car while his is getting repaired. The driver claims "I'm also a victim in all of this, you can't fix the lad's problems, but you can fix mine."

Kid didn't have reflectors. They both broke the law... I say if he wants to play it like that, give him the money for damage kid caused and put him in jail for using too much force to protect his property.

From the story:

The youth had been cycling alone at night without reflective clothing or a helmet, according to a police report cited by El Pais.

His family won 33,000 euros compensation from Delgado's insurance company after the firm acknowledged he had been driving at excessive speed and this could have contributed to the incident, El Pais reported.



Strictly from a legal standpoint, the man is only entitled to damages if the youth caused or contributed to the accident in some way. I don't know if wearing reflective clothing is mandatory or not, but it's almost certain that the bicycle itself has the original reflectors on it, and the story makes no mention of the cyclist doing anything wrong or riding in an unlawful manner.

In any case, the driver is a major A hole and if there is any justice to be metered out by whatever consciousness runs the universe, then he will pay dearly for this.

Poor form on all counts.

Stories like this seem to eminate most often from the US, so I was a wee bit (only a bit) surprised to see it from the EU. Litigious bastardry seems to be a worldwide phenomonom now.

When I started reading this thread, I was thinking how strange it was that our "U.S. lawyer sues dry cleaners for millions of dollars over missing pants" has actually been out jerked by some upstart from Spain.

Don't worry, I give it less than two weeks before one of our many contenders regains the title for the U.S. of A..

I believe it is U.S. law that automatically convicts the driver of manslaughter if he kills a pedestrian. Judging by the article, this law doesn't reside in Spain as well...

Nope. If cyclist doesn't have reflectors or lights and is driving on road at night he/she is to blame.

Few years ago i nearly hit someone who decided to ride their sag-way on a 50mph express way at 3am in the fast lane... I saw him late due to dirty lenses on my lights (been fixed since), but it took me extra time to avoid him/her because i couldn't believe it. It was extra delayed reaction, it was as if my brain was going "avoid! AVOID! CHANGE LANES NOW" and my back brain was going "God damn it, you high again? There is no way there is a sag-way going 5mph in my lane, this is practically a freeway and its 3AM!".

If the facts of the story are to be believed (and when are they?... it's the news), then the guy is a jerkoff.

If the kid caused the accident, however, I'd want to be reimbursed for damages as well. I've almost hit these morons before. You know the ones. They ride in the middle of the lane without any reflectors or lights.

I'd like to know who really caused the accident before judging the driver of the car. Sure, he may not have any tact, but he may very well be right.
