Question Received letter from lawyer re:Auto accident - Never happened!!!

Hi Folks,

maybe someone here has some experience with this and can help me out a little!

I just got a letter from a lawyer as follows:

This ofice has been retanined to represent the above mentioned for claims against you as a result of an automobile accident which occurred on July 12, 2009 in the vincinity of (address).

We would appreciate you contacting the undersigned with a view toward an amicable disposition of the above matter. In the alternative, if you are covered by automobile liability insurance, please forward this correspondence to your insurance carrier immediately.

I was never involved on any accident and never passed on the address they say in the letter.

What should I do?

I was thinking about calling the lawyer to ask details:
How was the accident?
How is my car?
What do I look like???

Being that was never ear the road they mentioned in the letter, they would go in contradiction.

Should I write a letter requesting such information? Should I contact my insurance carrier and they would take care for me with their lawyers???

make sure no one used your name or tags.....and start getting your ducks lined up just in case.....tell the other guy nothing until you have been served

Have you ever sold a car to someone for which you didn't get the title changed over to that person's name? If so then maybe someone had a wreck in that car which is under your name. Just a shot in the dark.

I suppose you could call the police and ask if any reports were filed on that date and location.

That's a possibility.
I was contacted for abandoning a car in the next city over from me. I sold it something like 4 years prior to someone whom probably never had it registered.


It has to be some kind of mistaken identity. Perhaps they got an incorrect plate number, VIN or whatever. Either way you have to call them. More than likely their information wont match yours. Or you're being framed. I wouldn't worry about it.

Contact the BBB, and the local bar association. (My paralegal fiance suggested). Check your credit to confirm that your identity is intact, we belong to lifelock, BTW. The police would have an accident report on file-if one was filed, and wait to contact that attorney so that you'll have harassment grounds to add later if any threat of further legal action follows. Don't let those attorneys interrupt your sleep pattern since you did no wrong, here.

Forward the letter to your insurance company immediately. Under the liability portion of your policy, your insurer has a duty to defend you against suits alleging liability, even if the allegations in those suits are false or fraudulent.

This is the only action you need to take. Let the insurance company take care of it for you. It is their job.

This is a FIRST good step... then inquire with your State DMV if your vehicle has any kinda unresolved issues from the past that look odd.. This whole thing could be a joke but why take a chance on that??

Thanks a lot guys, I will forward the letter to the insurance company. Should I write a letter to send with it stating that I've never been in that street and was never involved in an accident?

Another question: Let's say this is somehow related to the car I sold 2 years ago to the dealership. Do I have to worry or do anything besides contacting the insurance company?

You could always try dropping a deuce on the lawyers front porch. I don't think it will resolve the issue, but it may make you feel better.

Again, these are questions that you should be directing to your insurer and to counsel that your insurer may appoint to defend you.
