From the article... NEILSVILLE, Wis. -- The call came into the 911 dispatcher: "I don't want to hurt anybody. I'm drunk."
With that, Mary Strey, 49, of Granton, reported herself as a drunken driver about 3 miles northeast of Neilsville in central Wisconsin.
Clark County Sheriff's Chief Deputy Jim Backus said Monday that Strey's call on Oct. 24 led deputies to cite her for misdemeanor drunken driving with a blood-alcohol level double the legal limit to drive. She makes her first court appearance Dec. 10.
Backus said drunken drivers reporting themselves is rare.
In the 911 call, Strey said she wanted to report a drunken driver and the dispatcher asked if she was behind the suspect vehicle.
"I am them," Strey said.
She then followed the dispatcher's advice to pull over and turn on her flashers, telling him she had been "drinking all night long."

Our drummer got a DUI for being passed out in his car in the parking lot of a bar we played at. Blows my mind that you can get cited for DRIVING under the influence without actually driving.

Our drummer got a DUI for being passed out in his car in the parking lot of a bar we played at. Blows my mind that you can get cited for DRIVING under the influence without actually driving.

Tho I admit, it does seem a tad daft at times.

Ya know, the guy probably would have made it home with no problems, but because he tried to be responsible, he was hit with a DUI.

Typically cops will mainly give DUIs to people sleeping while the engine is running, or at least the keys are in the ignition. In that case, it's better than driving drunk, but not by much - because what many of these people do is take a nap and then drive home while they're still buzzed/drunk. Or do other dumb things, like accidentally rev the engine while they're sleeping (can't find the video, but there's one on youtube of a dude asleep in an Audi with the engine revving at the limit, and smoke coming out of the hood). For sure, it's worse to drive, but a lot of the people whining about their DUI's while they were 'just sleeping' are not totally innocent either.
That said, there are people who are arrested for DUI because they are in possession of the keys, and in proximity to the vehicle. Or sleeping in the backseat, but with the keys in their pocket. It varies from place to place what 'in control' actually means, and sometimes its very loosely applied.
And in any of these cases, you can still be found guilty of public intoxication.
If you absolutely MUST sleep in your car, probably the safest thing would be to unlock the door from a distance, hide your keys somewhere that you can later retrieve them (make a note if you're too drunk to remember) or give them to someone to hold for you, hide out in your car and lock the door. Better that you don't have the keys anywhere near you than in your pocket or even worse, in the ignition. |

At least in Tennessee you can still get a DUI even if you are in the trunk of the vehicle with the keys in your pocket. What determines whether or not you can be cited with a DUI is the location of the keys. If the keys are located anywhere inside the vehicle, be it on you or anywhere else, then you can be written up. However, if your keys are outside the car and are sitting on top of the back bumper, on top of one of your tires, on top of your hood, etc... you cannot be written up. |

The keys had not been in the ignition since I arrived many hours earlier before band practice. By the time practice was over about midnight I knew that I was not legally able to drive so I curled up in a blanket in the back with the keys in the center console.
After being charged, I consulted with a lawyer who told me that if I was in the vehicle and the keys were also in the vehicle then I was stuck with the DUI.
