Odd guitar problem

So i have this cheap epiphone les paul special 2. I have hardly even picked it up since i got it but when i do. the tone pot will randomly cut out and go into clean even though my amp is in distortion channel. So this is a problem with my guitar right and not the amp?

No. This is a problem with your amp. Your tone knob has nothing to do with your guitar amp switching channels.
