If you do not get this, you do not listen to this type of music. Therefore it is not meant for you to get. You are not meant to be at our show. Not a Dead or Phish fan so I'm unfamiliar with the artwork, but if this is someone else's art, you are profiting from someone else's work without permission. Technically speaking, these are sort of caricatures, but you are also profiting from someone else's likeness. I wouldn't use this.

I absolutely love it, the fact that is appears to be printed on blotter paper makes it SOOOO much more appropriate. The bottom parts needs to be equally as creative though, you should also mention that you are a tribute to jam bands and such, people will not go if they do not know what is to be expected. You will want to appeal to a little more crowd than the jam band crowd, nationally respected touring jam bands draw less than 30 people in some areas from what I hear, I play prog so I take note of what other genres have to work twice as hard, jam being one of them.

Ok, this is my big fear. That it is not my art work. So is it illegal to put a picture of the mona lisa on a flyer?

I think the mona lisa falls under free use, ask Roy Vogt I believe he uses the mona lisa in his teach me bass guitar ads.

Damnit. I don't know. To me if I am just putting up this dudes art on a flyer, not selling HIS work, what is the big deal? If anything I am promoting his work as well..

You will profit from the flyers on somebodys hard work, you will make money on the gig they promote, that is why it is immoral and illegal to use others work for your own gain.

What if he doesn't want his art used in this manner?

Though the likelihood anything negative ever comes from it is extremely slim, there is a certain morality that is expected amongst artists. I know I would be quite choked to find my music somewhere I didn't want it.

It IS a big deal to the artist.

a) you don't have his permission to use his/her intellectual property.

b) you are not crediting the artist.

c) yet you are using the artist's labor, which has intrinsic value, to promote your enterprise for financial or other gain.

As a marketing guy, I think your bands' energy and time are better spent creating its own identity. Flyers with unique and genre-appropriate graphic/type treatment, strategically placed where your audience is likely to see them, will get you off on the good foot.

To the OP: Find a good graphic designer who's into jam bands. I bet you'll like what s/he comes up with. Design students would love to take a crack at it as a portfolio piece.

as a general guide: in the u.s., using a creative work that you did not originate is a copyright infringement. there are a few exceptions: 1. the work is in the public domain (i.e., existed before 1921--and there are a few exceptions to this). 2. you are licensed to use the creative work (ex.: public performance licenses for music). 3. you have the permission of the work originator and/or the copyright holder (ex.: many grateful dead concert recordings).

Possum (Phish) transitioning into Franklin's Tower (Dead) transitioning into ACDC Bag (Phish) transitioning into I Know You Rider (Dead).

There's terms for song medleys like Help/Slip/Frank, China-Rider, Drums/Space/Wheel that most deadheads will know. It's not that different from shorthand that a band uses for their set lists; i.e. 'Handle' instead of Hard to Handle.

Actually, I do listen to it and we cover a fair amount of it.

Actually, no, it's Phish caricatures on the flyer, with a GD Uncle Sam and a poster of someone that could be Jerry.

I disagree with others who dislike the image, it's cute and obvious enough for people "in the know" to know that it's not Phish or the Dead that are playing.

That said, you could just have psychedelic art and the text "Possum>Franklins>ACDC>Rider" is *plenty* enough to give it away to those people who are going to know about it or be interested anyway.

As a phreak myself, I love this poster. Possum > Franklin's > Bag > Rider is badass, it's like secret code for phans, and so is the picture.

That's what I thought too; didn't really get it at all. The "AC/DC" part would put me off for a start, but that's a taste thing.

I don't know to be honest, but I don't know the names of songs from a lot of my favorite bands. I was just thinking about it this morning actually, listening to a top 10 album for me when my favorite song came on...I have no clue what it called

I got the explanation from Jive, I don't see a need to dig into it further.

Okay, I just read Jive's explanation. Not many people are going to get that, so you'd be limiting your audience to all but a few. For that reason alone it's not a good promo. I would go and have a listen to the sort of music you're playing, but those references are too obscure for me to know what that is.
