HELP - Getting shafted on room rent, need suggestions

We split a practice room. The other band is leaving and I am taking over the lease. The guy from the other band will be getting a check for the security deposit and cutting me a check for my half which I then need to turn around and give to the management to cover the new security deposit I'll owe as the new Leasee.

He's the fun part. The guy who's supposed to cut me a check wants to post date the check by a few weeks cuz he's having financial problems.

This leaves me stuck covering a good portion of the security deposit on top of what I would already be paying. I already seems to be taking on the Lion's share of management duties for this band and am at wits end with this one.

Maybe I am just venting but does anyone have any suggestions in dealing with a situation like this?

make him keep up his part of the rent till he can cut you a check that won't bounce.

Security Deposit

Who put up the original security deposit? If the other band put up 100%, then the room manager would prob. have to give him the check.

If you put up 50%, then, it's not unreasonable to ask for 2 checks each for 50% of the deposit.

Being the cynic, if he gets the entire check and post dates you a check, you will probably never see your half of the money.

These are always sticky situations. If you don't have a contract or some document showing that you are due half the deposit, he can walk away with the money and you will be screwed. If you are friends, you friendship will be at risk if you push too hard or worse yet, if he doesn't give you your fair share. Like I said, these situations are never easy.

I can only think of this senerio: you'll "agree" to his post-dated check suggestion (under duress of course) but not without an asset to keep things, well... honest... Have him give you something.. a tangible piece of gear of equal worth to the amount he'll write on the check. If not, then tell him its not a 'comfortable' idea for you to take a risk like that.
