Ok, well we polled our fans, and we have decided that we are going to now go with the name "Incisor." I personally think it's a little bit of a silly name, but we did a band vote and majority ruled. The other two guys really really like the name, and apparently so does the audience. So now: what do you guys think? Yay or Nay?

I like that name. I thought your suggestion of "Cadence" was good too.

Those are good 'you don't have to explain it' names.

Actually, IIRC there was a local band calling themselves Metallica a while back. They recieved a cease and desist order from real Metallica's lawyers. Granted, this was shortly after the whole Napster thing went down. Maybe it's different now.

So, what's the general consensus if I were to name my band a certain name, even if I know there's another band out there with the same name (but no where in our area - it's on the west coast of Canada). Can't seem to find it trade marked either...

Is it "uncool" to just take the name, trademark it, and call it our own? Not even sure if we'd bother going the trademarking route, as I don't think we'd ever make it big... but you never know.

I'd say that use it if you like it, and whoever rises to prominence first will prob. be the one to keep it. Unless you go the weasel-y "I'm going to trademark this before you" route. I say do it.

It just seems like your asking for a headache, later on down the road. Is your band serious? Are you planning on making records, maybe touring someday?

If so, then keep looking for a name.

If you're just playing covers and will never leave your basic area, or it's a not-totally-serious band, it probably doesn't matter.

What you wouldn't want to do is spend 5 years building up the name "DUSTY SPRINKLER" and then find out there's already a DUSTY SPRINKLER out there, meaning any name recognition you worked for will be worthless, because after 5 years you have to rename yourself.

I would just look for a new name, since you're just getting started.
