for the last 11 WEEKS i have been suspened on a false sexual harrassment charge.. i called the union rep and we are trying to get it resolved...but he always says he will meet with the Human Resources guy and call me back... but he never does and when i call him he apologises and gets in touch with the guy... well it turns out that my file was LOST...so now they have nothing about the girl's claim...sounds good for me right? well i wouldn't know because the guy hasn't called me in 11 days...and i just tryed to get in contact with him again...and now he went on vacation until monday the 14th... grr im so mad right now for those of you that have NO clue what i am talking about...here is the thread... Thread About It now i have two choices...i can ride it out...they will owe me a WHOLE LOT of back pay for suspending me unjustfully.. or just say screw it all and quit...

I'm not a legal professional, but I have been in the same exact boat. By law some companies and institutions have clauses that say false accusations are grounds for termination. I've never seen it enforced, though. This may be because it's so hard to actually prove malicious intent on the part of the accuser. In my case, it was impossible to prove any sexual harrasment on my part because it was he said/she said, and all my co-workers as well as my boss knew it. However, SH cases have to be taken seriously by law. A false SH charge isn't in the same loop with all employers. I was ready to walk, but the (maturity suit on)young lady quit. Then I walked. Life is too short, and my job was stressful enough without the drama. I know a few guys who are a lot of fun outside of work, but have to be straight-laced unemotional squares on the job to avoid what can happen. My intent here is not to flame or offend, just to share my experience.
I didn't see the girls age mentioned. If she is over 21, you have a very strong case for a lawsuit. Either defamation of character or slander. Even if you did commit the offense, the burden of proof is squarely upon her. If she claims that the two of you were alone when the incident occurred there is absolutely NO way that she can prove anything unless you make a confession. The store cannot legally fire you for a crime without involving the police or they are wide open to the same charges that she is. Whoever said that you need to stop discussing it with anyone offered sound advice. GET YOURSELF AN ATTORNEY IMMEDIATELY! Pkr2

lol, thats true. Should have thought of that. Well I say you get an attorney and settle this thing once and for all. If things go well you will keep your job plus you can laugh in the girls face if she keeps hers. (dont seriously laugh in her face, it will cause another lawsuit...)

well...i can't believe it....the girl who got me suspended had enought guts to CALL ME tonight....TWICE!!! the first time i picked up and hung up cuz it was busy...(it was on my cell phone and it came up as blocked number)...30 seconds later it rings again...heres how the convo went Me: Hello Her: Hey Baby Me: Ok? Her: What's up? Me: Who the hell is this? Her: Oh you know who it is. Me: (bad word) you! *Hang Up* i can't believe she would call me after what she did
New Evidence! Case Closed! Show the appropriate people the record of her phone # as an incoming call on your cell phone (with the date and time of call of course). This is a dumb move on her part (if she called from her phone). A true (sexual assault) victim's Attorney would lose his mind if he found out his client had initiated contact with the accused while the case is still pending.
1 Write everything down that happened. 2 close this thread and stop talking about it with anyone via internet, email, or whatever. (note: you are on your own! except for step 3) 3 Get a Lawyer!
It would be a REALLY good idea to be ready to record any future calls that may come in. My girlfriend had some problems with a psycho boyfriend once upon a time -- ever see the movie "Sleeping with the Enemy"? -- and the cops wouldn't do a thing until she played them some voicemail recordings he left her. Once the recordings were in their hands, though, they did not hesitate to prosecute the hell out of the guy. The point, however, is that it was up to her to produce that kind of evidence. Don't expect the authorities to be overly sympathetic unless they have something they can really sink their teeth into. Good luck with this! P.S. Maybe I'm missing something, but what does this have to do with Acme? I was looking for threads on bass cabs...
