Band names - The XXX vs. XXX

  1. Changing band names. A name recommended was "Specialist", named after an Interpol song. There is a band called "The Specialists". Can you get in hot water for using the singular version of the name?

    One of the bands I played in kept changing names often. We did it so often in fact that the club we played at the most, a little neighborhood dive that is still open just with totally different owners, used to put on the marquee "Thurs nite those same guys again"

    Then we would come out and introduce ourselves as whatever we were calling ourselves at the time and this one waitress would heckle us with our old names. " Hey! Didn't you use to be OnQ? (pronounced 'on cue') Didn't you used to be Second Wind? Weren't you Emerald City? I know! You were Catholic High School Girls in Trouble!" (The last one was NOT in fact, true.The others unfortunately were.) We should have been called 'every couple of weeks' because that's how often we tried on a new name.

    The heckling waitress was a lot of fun actually but I finally convinced the singer we needed a GOOD name and to stick with it.

    Band names often get abused - people think nothing of dropping a definite article in front, etc. Therefore, if you want to avoid confusion, I'd say that Specialist should be avoided - people will write it up as The Specialists.

    I was in a band in the early eighties that had a lame name. But we established it as a business, and it was a fun time so we kept it going for a number of years.
    One day a bandmate came home with an album by a British band with the very same name. We had released an EP about 3 months prior and shipped it everywhere. About 3 months later, this other bands legal arm sent us the appropriate letter on very nice stationary telling us to; "cease and desist".

    Since we had a bit of "history" on our side, I reccomended that we ask them to "pay us to cease". And let them expend capital to do the "legwork". It might have been easieer for the other band to pay us off rather than any legal action. They could have refused, and we may have acquiesed, but if they accepted, we could've got some gear, or recorded another EP.

    In the end, my bandmates chickened out, too impressed by "the letter". They decided on an even worse name. I was outta there.
     
  5. I heard that's the reason Talking Heads named an album "The Name of This Band is Talking Heads."

    Disclaimer - I'm not saying it's true, it's just something I heard. :cool:

  7. My band is "Koala" (which I desperately despise the name) but I like to refer to it as "The Koala" or "The Koala Rock and Roll Revue." :D

  9. You should probably avoid it if possible just to avoid possible conflicts down the road, especially if you think either you guys or the other band might actually go somewhere serious. That said, however, I know of one existing example: there is a local punk band called Caulfield, been around for a while (I think I've got a T-shirt of theirs in storage somewhere from a show I saw or played with them years ago), they've got at least one CD... you may also recall The Caulfields from their mid-90s minor hit "Devil's Diary" (great song, BTW). I'm not sure if this helps, but I know the situation has happened before in my area at least.

    Also, I think The Used (ugh) had to add the "The" to their name because of another band called "Used". If that was enough, you might be okay after all, since singular/plural wasn't even an issue in that case.

    Ah, who am I kidding giving advice on this subject, I've known of at least one other band with the exact same name as mine for years and haven't done a damn thing about it. :oops:
