Same here, I'm a long-time cyclist--road and offroad. These days I try and only use the road as much as absolutely necessary to get to the dirt, and even then I'll take the long way if it's less populated. Always with running lights blinking away, riding defensively, doing it all "right", yadda yadda. People drive like idiots.Bicycles and motorcycles are more invisible than ever, since cell phones proliferated. My motorcycle is long gone and I really don’t ride a bicycle on pavement any more.

I walk the dog on the nature trail just steps from my front door. This happens to me often. Once in a while, I'll get a ding! or a "on your left" sometimes they WHOOOOSH! past without warning. Getting hit that way would also hospitalize someone.Sorry to hear about your accident, and I hope you have a complete recovery.
And thank you for being a law-abiding bicyclist. I, myself, was almost wiped out last week *by a bicyclist.* I was walking my dog, and a high school kid on a bike came flying up behind me, on the sidewalk. No "On your left", "Heads up" or anything. I heard nothing. My dog innocently almost pulled me into the bike rider's path, impulsively veering off to sniff something. A handlebar grazed my shirt. No "Sorry."
Motorized scooter riders are also a hazard. They stay on the sidewalks to be safe, but endanger pedestrians.
Anyway, best wishes to you, and I'm glad it wasn't worse.

Man, no way that driver was even remotely paying attention. I mean, you're right there, plain as day! Where the hell were they looking? Dang! Coulda been anyone--a little kid, a mom pushing a stroller. They're toast.

My only concern would be if there's any law requiring cyclists to walk their bikes through crosswalks in your area (or not riding on the sidewalk for that matter). It varies all over the place. That would be the only angle I think they could try and pull given that video evidence. But even then you very clearly did not "come out of nowhere".From your post to their insurer's ears.
This is a good point if you are going without an attorney. Your health insurance will have a lien for their costs, and 99% of the time they send a letter letting you know this. However, the subrogation industry is, as a whole, incredibly slow and disorganized, so it can sometimes take a while. If you settle on your own and don't expect to owe your healthcare costs that'd be a terrible surprise.If you get an insurance payout and your medical covered hospitalization, your medical insurance may be able to after reimbursement from any settlement. Just something to be aware of.
Just to defend your friendly neighborhood law firm, there isn't really a "smell the blood" situation with cases like this. It's a percentage (don't pay over a third), so to make a lot off a case you need a massive amount of medical bills and pain and suffering, and either a driver with an equally massive policy, or any policy and the cyclist has a massive amount of UIM coverage. Any law firm that fist pumps the air over a severely injured client is not who I would want to hire.the law firm can already smell the blood in the water. Don't go easy on this one, you deserve nothing less than full compensation and then some
Video is great evidence. A police report with the exact code violated is as close as it gets to perfect.Insurance companies will lean with all their might on police reports as an "official record," and try to use them to get out of a payment / settlement. With that in mind, if you have not already done so, you and/or your lawyer need to send that video to the police chief and/or shift supervisor of the cop who didn't cite the driver. Some jurisdictions will allow for submission of further evidence and an update of the case, or addition of a supplemental report.
Bad enough that driver hit you, worse still that the cop didn't do his job. That needs to be seen to.
Good on you for getting the video, and good on the city traffic people for getting it to you quickly.

I know where I live you can only ride on the sidewalk if you're under 14 (or maybe it's 13--I'm an avid cyclist so I would never take the sidewalk anyway - I actually believe it can be more dangerous, but that's a different discussion).

Yellow-red light drivers trying to shave minutes off their commute can easily ruin the entirety of someone else’s life.I bike to work most days, and this probably my worst fear (not to mention my wife's.) I have 2 major intersections to cross on the way to work. I have seen 18 wheelers blow right through red lights at the first one. Thankfully, that was after seeing cars (and a bus!) do the same, so I definitely don't take it for granted that people are going to stop even if the light has been solidly red when they get to the intersection. I've also been honked at by someone turning right into the hospital, even though they had the red and I had the green; seems they were upset that I didn't yield to them even though I had the right of way.
I also cross those streets at cross walks, but that's certainly no guarantee. So I don't just go immediately - I look around like 5 times.
Anyway, I really sorry that happened but I'm glad you're relatively intact. Best wishes for a speedy recovery and def go after the driver's insurer.
