Odd question

    Ok so here it goes, I live in Virginia and need some help on their laws and/or other states laws on certain things.

    If I were to be driving a group of friends that were high, and or drunk, when I was 17, we were pulled over; the cop comes by see's 4 people in the car, at 17 in VA you can only drive a maximum of 2. The cop then notices they are intoxicated in some manner, I only missing a stop sign, wasn't driving my car, but one of the intoxicated kids....what would the punishment for me be? Now keep in mind I'd be completely sober in everyway possible.

    I'm guessing because it wasn't my car, and because I was 100% sober that I'd be charged with the stop sign and possibly the exessive amount of kids....but would I be placed in any kind of drug trouble?

    I don't know the laws of Virginia but I doubt you would be charged with any drug related charge.

    There is one exception however that seems fairly universal across the US. If someone stashes dope in the car and the police find it, no one claims it and since your "in control" of the vehicle even though its not yours, the drug possession charge would fall on you. I hope that didn't happen in your case. Thats the reason I won't let my stoner friends ever carry their crap in my ride. I'm not getting popped for their junk!

    Nothings happends to me, just wondering on certain cases for you know....future events that *could* happen.

    As long as there are no open containers of alcohol in the car or drugs, and you are stone sober, then you should be in the clear. If anything, the cop would be glad that you are being a responsible designated driver, keeping three intoxicated people from possibly driving themselves home.

    Ya that's the plan, and that's what I'm hoping is gonna happen. I just need to make sure it wont hurt my license in anyway....the good news is I think one of the people is quiting what he's doing so that's another sober to go!

    In NJ cops have been known to congratulate people for driving too many underage drunks home, even without having licences. Happened to my neighbor, and just to be sure everyone made it home safe, the cop escorted her around town.

    It's usually just a slap on the wrist in a case like this, if that.

    Hi, I live in Alexandria, and I'm 17.

    I believe you would still be charged for being in the car because you're considered an accessory. You would probably be prosecuted for numerous driving violations (running stop sign, too many people in the car, etc.), as well as endangerment, accessory to drunk driving and underage drinking, possibly some other things like violation of driving curfew, etc.

    Overall, you'd probably end up paying a hefty fine, having your liscence revoked, and possibly doing some community service.

    I think its going to vary greatly on 1) the cop that pulls you over, 2) your level of respect you show him when he gets to the window 3) your rapid explanation that you know your in the wrong but you felt you had to drive them home to prevent them from trying to drive themselves.

    You get a police officer thats a career minded person who's got a family and actually cares about society as a whole and your probably going to just get a ticket for the traffic violation for running the stop sign.

    If you get a police officer that sees all kids as punks and a waste of space and you might end up in a world of trouble.

    And I think either way if there are open containers or drugs visible when he gets to the door your going to get free room and board for at least the night.

  10. Yep, here's your answer.

    So, what did you tell the officer? Did you say things like "Yes, officer," or "No Officer?" Or did you back talk him?

    Since you are posting on TB, I can guess that you didn't get arrested on the spot. BUT, you will pay a pretty hefty fine for missing the stop sign. Those usually get cops angry anyway.

    Next time, make SURE that no one has anything on them, have your liscense readily at hand, and DON'T speed, miss stop signs, blow intersections, or whatever. If you show that you are being resposible, USUALLY they will let you off with a warning or small ticket. If you are being sober but stupid, then you'll get your butt handed to you on a small piece of pink paper.

    I haven't been pulled over; I don't even have my license yet.

    I'm asking this because I want to make sure that the most that can happen to me is the stop sign fine and maybe to many people in the car. I definitely wouldn't be driving after curfew, that's just retarded...although so is driving 4 underage drunk and high people heh. There would definitely be no open bottles. I'm guessing there's going to be smoking paraphenalia just because there has to be a place to store it..so maybe I need to make sure it's on them and concealed at all times?

    As for speaking to cops, there's no way in hell I'd back talk. Yes sir, no sir, and sincerity is the only way to go.

    Man dont worry about it! The USA courts are all about the money! They will fine you what ever it tells them in the books that they can fine you! Thats just the way it works. Kinda like going throught the check out line at the store. So why r you here traffic violation with drunk kids, as the judge looks it up wam bam - 150 bucks next!

    Maybe in Missouri. I've had lots of friends who've worked out very generous deals and whatnot with reasonable judges. In fact, people here get deferred judification all the time for speeding tickets. That just means that the judge says "If you don't get another ticket in the next year we'll dismiss this one."
