Let the Buyer Beware...part deux

As documented in this thread:

http://www.talkbass.com/forum/showthread.php?t=376982

I'm updating the latest communication.

After a year had passed since I ordered a Lakland DD and recieved no confirmation what so ever from the supposid Lakland "dealer", I contacted Lakland directly to inquire as to the status of my order.

I recieved the following e-mail:

"Gil,

I hate to tell you this, but we never received the order for your bass from Steve. Steve is no longer a dealer in good standing with us. Please let everyone at talkbass know that, if you could.

Just please let the folks at talkbass know that we're going to do everything we can to take care of you."

As I reported earlier, I have filed a formal complaint with the Arizona State Attorney General and have recieved a response from them saying that they are investigating this matter.

I sent a private e-mail to Steve advising him of the fact that that I was dealing with Lakland directly and that he was completely out of this deal and to return the $500 deposit immediately.

He responded by way of member feedback on the DudePit by saying of me:

"Guy is an edit - cover profanity completely ~Mod., avoid at all possible costs."

Then 2 hours later this:

"Refund will go out to you on Monday (11/13/07) however be warned that further public postings as you did on Talkbass may result in libel litigation against you."

I will update this saga as further developments warrant.

Thank you for your indulgence and patience,

Gil Irwin

Gil, you best be practicing holding your breath! No wait, don't hold your breath.

The funny thing about his comment is that you only posted four or five times in that whole thread.

I got involved reading that thread like a good novel. I hated when it ended. I'll tell you this, it led me to some very disturbing findings.

After the thread was closed, I started searching for more info on the parties involved which led me to another bass forum (which shall remain nameless). I got the creeps reading some of the posts there. I felt like I was in the midst of a cult!
Very strange....Good luck!

BTW, your thread got me thinking about a Duck bass. I'd been admiring them from afar and lo and behold, one popped up here in classifieds. I received it today and WOW! Lighter than I expected and a true delight to play and view.

After reading for hours all the threads related to this problem, my only conclusion is that you should start dealing with this via phone, directly with the involved parties.

It seems that Dude likes to often say ''...I'll do it on Monday..." Don't wait another week or month to then post another thread, hoping to get things get resolved.

Call him right now, and ask him to please send the refund via Priority Mail or Fedex. Get a tracking number. E-mails and Internet forums are not the best way of communication. Get on the phone.

Did you pay the deposit with Visa? If you did, just call them. When Visa gets involved they make refunds first and ask questions later. Usually all it takes is a phone call. In one instance I had to send documentation of emails and phone call logs. Then just hit your Staples Easy button and relax.

+1 on that. Some dude stole my moms credit card (Visa) and used it on a betting site, for 900 €!
Visa just phoned my mom up, asked if she did that transaction (since she hadn't used it for more than the occasional book order from Amazon). She said no, they said "Okay, just checking, we'll block your card and send you a new one ASAP." And that was that. Week later she had a new card.
Get Visa or what ever creditcard company you used involved, they stand behind their customers 100%.

That dude guy seems like a jerk. But hey, every body deserves a second chance.

If only "Dude" felt that way about others. He banned me from his forum because I had the nerve to disagree with him here @TB. No big deal, I'd only been there a couple times to get information from his Walnuts forum. It simply confirmed my opinion of the guy.

Interesting reading. As per a telephone conversation I had with Dan Lakin I am still a Lakland dealer and Brian Gingrich spoke out of turn in his absense via a private email he sent to Mr. Irwin he did not intend to be publicly posted but it was..no big deal either way. The truth is indeed an ultimate defense in slander/libel cases and I did indeed drop the ball on this one and I'm sorry.

Lakland is making Gil's bass and I will contact Dan over the weekend if I can get in touch with him or talk to on on Monday to see if I should send the refund to Gil or not but as far as I am aware all Gil will be liable to send to Lakland when his bass is ready is the original quoted price less the $600 deposit and the rest is between myself and Lakland.

I will return to this thread and post the outcome no later than this coming Monday at 5:00 pm Chicago time.
