It's a very common tactic to create the illusion of exclusivity, to get people to buy the product quickly.

I don't think it's a scam. I got it too and I scheduled a phone call to see what it's all about. I can't imagine there only being 40 spots though. My guess is they'll come back with "due to an overwhelming response, we are opening more spots", or something like that. And the original email says...
