It's a bit of a tradition in New York for the iron workers to not tie in. I saw a documentary on the building of the new world trade center and even on that building, they were not tied off. I was really surprised to see that with all of the OSHA regs that there are now. They would not have fallen as far as those guys on the Chrysler building or the empire state building since they deck the floor below as they hang the steel for the next one up, but it's still far enough for OSHA.And to think how easy it would have been to simply tie a rope around them, anchored to a beam.
