Inconsistent results from 'Forums' button?

Using Safari on ipad, when I push the Forums button, sometimes I get this...

...and sometimes I get this.

Not that it makes a big difference. Either ways gives me the same links, just formatted differently.

Just seems strange. Is it just me, or does anybody else get this?

Yes, you get the drop-down meny when you're already in the forum section, otherwise you just go to that section's start page.

Mixed modality of a single UI element, not a fan. If the function is different, there should be some kind of visual indicator or a secondary element.

Perhaps a label change? Forums when it's a navigational element and Forums Menu or something of that nature when you are in the forums? Not perfect, but it would let users know that the function has changed.
