Kubicki ex factor problem

hi all, I can't seem to get the drop d piece on my ex factor to stay open. It only opens to maybe 30 degrees. Thanks for any input!
Lift the D-capo with your thumb, bend the string down toward the A string with your finger(s) and release the D-capo to rest (embedded in the fingerboard) under the string. One handed operation once you used to it.
 
Weird question. I guess the mechanism is unusual enough that its regular operation isn't necessarily obvious. I wonder why Kubicki never licensed this to anyone? It is an innovative idea that allows drop tuning without different fingerings. It would never be mainstream, but I can certainly see it being a feature on a boutique.
