being sued over band name

Here's an interesting case which went to the high court:
Judge rules in battle of the ukulele orchestras
Long story short is that there's a longstanding British-based group, and another group from Germany. The names of the respective groups, their repertoire, stage shows, and manner of dress are all strikingly similar. The British group sought an injunction against the German group.
IMHO there's one clear winner:
 
do what the Australian band impaler did.

American shock rock band of 30+ years called Impaler Impaler (band) - Wikipedia, the free encyclopedia contacted Australian Hardcore band Impaler (who only recently formed, maybe 2014) telling them to stop using the name or prepared to be taken to court.

So Australian impaler responded with the following.

"You're just a sour old prick
A little bitch, you backed out
Do this again, we'll call you out
30 years bad luck?
You didn't make it because you f**king suck"
