Rule #1 of the music business: never pay anyone to make you sell tickets. I'm hardly a seasoned road warrior and I learned that hour 1 of first practice. Some have told me to never sell tickets directly at all.
If a promoter prints a single poster, and sticks it on wall in some dark dingy alley, he promoted you, even if there was zero chance of any breathing human being actually seeing it or knowing about it. Grey area in the law. All they have to to is make some kind of attempt.
A lot of this stuff is spelled out in the contract there, if you agreed to that, I feel sorry for you. I did not even get half way through it before I said "not a chance in hell."
