Truthfully, I can't tell if this is a sincere comment, or an innuendo. but whichever, The O.P. asked "what would you do" ? I answered accordingly. Winning a popularity contest didn't even cross my mind. As always, Your approach may vary.

As far your brothers case is concerned, I don't think he's committed any crimes, so the manager would be hard pressed to get a conviction I'd have thought.
