can't take it any more...

I don't know what to do. My divorce has been going on 2.5 years now, because my ex is milking me for money awarded to her in the temporary orders. She will not cooperate in any way, won't respond to emails or letters to her attorney, and doesn't go to any court ordered meetings, unless it's a formal hearing. She tells lies and disobeys court orders but for some reason they don't charge her with contempt, despite repeated motions, they always get dismissed. I, on the other hand, quit my job due to stress, so I could go back to school, and so I can get my medications for free (I couldn't afford them paying 65% of my check to her for support) and the judge tells me she's going "to throw the book at me when it comes to child support" because I voluntarily quit my job.

We finally started the trial, which doesn't continue until April. Meanwhile, all the creditors are coming after me for credit cards, the house, etc that I can't pay for, because it's all in my name. I go back to work in June, but creditors have seized my bank accounts and are now trying to take any other assets I have (cars, motorcycles, etc). Once I start working they will garnish my wages. All this can be prevented if I file bankruptcy but I have to wait until the trial is over and the judge issues her ruling. I am going to declare bankruptcy, but I can't until the divorce is final. My attorney said our judge has waited 2 years to hand down rulings before, and he has a case still open from 2008 she hasn't ruled on. She's old and not running for re-election so is pretty much doing whatever she wants.

My ex's boyfriend is hanging out with my 6 year old daughter, which is prohibited by the temporary court orders. The judge has told her several times to keep him away from her, but she doesn't listen. This guy is sleeping in the bed with her and she's been getting yeast infections and complaining of irritation. I filed a restraining order, the judge rejected it. Today I filed another one, because my ex brought the guy to my house with my daughter last week. They rejected it as well. Both times because I have "no proof". I'm scared for my daughter and for my own safety, because this guy was blown up in Iraq and sustained a traumatic brain injury.

I'm not looking for legal advice, my attorney is doing everything he can. I guess I'm just wondering if anyone has been through anything like this before, and if they can suggest anything that will help. I am literally at my wit's end and don't think i can deal with this any more.

EDIT: I am already in therapy, and I don't drink so don't suggest alcohol or drugs.
 
Good Lord... I'm so sorry, that's horrific.

I'll also second calling the police about the possible child molestor, not filing a motion. What's visitation like? If you get her for a weekend, ask her what's been happening and then call the cops. They'll enforce an existing order, and if anything else has been going on hopefully investigate the guy.
 
Please let a Doctor examine your daughter and if results tell a story (besides what SHE will tell you)-call the police immediately. Can you get a change of venue away from this judge? Ask your attorney to do so---you may have plenty of valid reasons. Do not assume attorneys are all-knowing people you have to follow blindly. They make mistakes, overlook common sense things and you have to ride herd on some of them sometimes.

i'm also thinking that your attorney is lame!!! seek new council, IMHO. good attorney's know how to make deals quicky. my son hired a swag-less lawyer to defend a weed charge and wasted 7.5k. the next time he got in trouble, he hired a slick New Yorker who knew her "ish" and even stumped the judge with her knowledge of freshly amended laws. this resulted in a 4 year sentence in a state penitentary being turned into 8 months in County Jail.

the Judge was both embarrassed and humbled! it seems your lawyer has either no clout nor up to date info on divorce proceedings. he has to fight to get a contempt ruling,... the Judge isn't going to just grant it, IME.

good luck with this crap and again i am sorry. i've been through the same crap. i fired my lawyer and made a deal with my Ex that she couldn't refuse!!! i even got full custody of my 2 sons. i took the money being wasted on lawyers and court costs and conned an evil, materialistic female.

get with a new attorney

sit down with him, write up a plan of attack...

cover everything on it and i mean everything in detail

carve it up into sections

whats going on in the past, now and what you want in the furture and how its going to get there plan.

get some actions going and stick to them...

hit it bit by bit

stay fit, get sleep, dont abuse yourself or make yourself weak in anyway

document everything...and i mean everything associated with the seperation, build up cases to be talked about in court

never give up
 
+1 on hiring a new attorney. Courts a extremely biased in child custody cases.

I've never been married, but I watched my parents go thru a similar situation when I was a kid.

Best off luck bro, your post made me pretty angry.
