the feds are hard-up! they are constantly searching for ways to claim land or have you pay for "new" violations. i know of several California land owners who are getting "red tagged" on structures that pre-date these new violations!:( all it takes is a few variations to current zoning regulations and you could lose. Lord help you if there's water on your property!:eek:

It's probably a conspiracy to help track down telepathic bigfoot.
 
Edpal is mostly right, when he says that unclaimed land became Federal land when territories bacame a state. However... up until the Civil War (when Nevada became a state), the Feds normally ceded the unclaimed land to the new state, since, as a former territory, the land was theirs anyway. In the case of Nevada (and all the states since, AFAIK), the Feds kept the land; which is why this guy has his ass in a real deep crack, and why about 3/4 of Nevada isn't really a state. It still belongs to the Feds. That's the reason most of the counties here are poor as church mice; they can't raise any revenue by selling land, and collecting property taxes, because they don't own any. And the Feds won't 'fess it up, like they did prior to the 1860s.

So, unfortunately, this guy is breaking the law - Federal law - by grazing his cattle on Federal land without paying the grazing fees (which was about $4 per "cattle unit" per year, last time I paid any attention to it; ex-wife was a rancher's daughter). I'm just surprised that he got away with it for 20 years.

And, the ugly, secret truth is that almost all ranchers out here pay those fees, and graze their herds on federal land. They have to; there's no other land to graze them on. Uncle Sugar pretty much owns it all. Maybe this will become a big enough stink that the situation will be fixed - but, after 150+ years, I'm not holding my breath. :)

This is real drag for a thread about stoner cows showing up for work but being clumsy and unmotivated. But they do keep munching :eyebrow:
 
Like anything else, there is probably more to this story. It seems that Bundy's history with this land goes back a LONG time, as his family has apparently been grazing cattle since the late 1800's. How the land was classified at that time I have no idea, but this was well before we had a BLM, national parks, preservation areas, etc.

I don't exactly know what Bundy's story is from the last 100 years or so, but if we had some more accurate information on a timeline, if might shed a little more light - maybe in his favor, maybe not. However, I think this FAR more complicated than simply "cow farmer freeloading on government property",

What people have un covered here is, Oil companies want to engage in Fracking in the lands and his ranch is in the way. The BLM said this was about protecting a turtle that is on the endangered list but it's come out the funding for the turtle reserve is being cut and they are going to Euthanize ALL the turtles. Not even offer up a single turtle for adoption.

His cattle are a huge problem for the BLM but it's no problem at all the litter and damage done to the lands from the illegal alien smuggling that goes on in the desert. NO we need them to pick our crops it's said otherwise you won't be able to afford a salad!

I guess no one gives a d*** about higher prices for your streaks though if ranchers can't use some grass growing on the ground no one else has a use for.

One of the last times Federal Snipers surrounded a homestead a woman with a baby in her arms had her head half blown off. Snipers are surrounding the ranch now.

The solution here is with the State Governor, he has expressed dictates for the actions of the BLM. He should call out his National guard and state police to insert itself between the two parties and force a reasonable and legally attained compromise. And if the BLM starts shooting at state forces the orders should be to take no prisoners of anyone resisting. Time to stop playing games here.
The Alphabet soup agencies, BLM, AFT, FBI, NSA, and DHLS are all creations of the executive branch, no one ever voted on their creation. They are illegitimate as soon as they start acting outside of the Constitution.

There are a few laws I bruise. Speeding on occasion, mooching a parking spot in town for a few minutes... I don't live very far off to the outside. I'm boring, Yes I know... But if I get caught, I expect to pay and will pay and when I get over it, if history is an indicator, I'll revert back to similar behavior. *

If Mr Rancher doesn't like the law, then he needs to get to his congressman and lobby for a change. He doesn't get the right to ignore the law without paying the cost. I don't. None of us do. Unless you are very wealthy and well connected.. Don't like the way the system is stacked ? Get your collective on and vote in some folks with heads on their shoulders. Ones that understand how to legislate and that they work for voters as opposed to contributors.

Years ago I went to traffic court. Was a little later than I wanted to be got a seat down front and center next to a maybe 18, 19 yr old guy. We chatted briefly as the judge was not yet there. He asked why I was there and it was for running a red light. $184 plus mandatory court appearance. Mitigating circumstances, late at night, no traffic, rural but... Guilty, Guilty, Guilty to quote Oral Roberts. In the interest of at least appearing respectful, i go formal business wear in suit and tie. So I asked and he was there for the third speeding offense and court appearance in 6 months. Really high speed too. This was it for his license. Unmitigated stupidity and I'm sitting next to him thinking guilt by association... We get the All. Rise and the judge walks down the center aisle. As he walks by, he stops. Checks me out giving a very stern look and says 'Are you his new lawyer?' I'm like no! And can see now he thinks I'm probably his uncle and taught him how to drive... Nobody else would have been dumb enough to sit by him. Small town. Everybody knows everything going on. But see, I'm newly transplanted here. Really off to a nice start too:D I'm thinking I should have chanced the speeding ticket to get there earlier... Guilt by association...
