I won an item that ended on 11/21 and I paid immediately with PayPal. I haven't heard anything from the seller regarding the item being shipped yet, and I just sent them a message just asking what's up. If they don't respond, when is it the appropriate time to bring the issue up to eBay/Paypal to get my money back?

Does the seller have a good reputation? I'd also suggest that many people were on vacation this past week, but that would not excuse poor communication form the seller.

Per paypal rules you must wait 7 days for shipping in order to open a dispute. I'd send an email giving the seller until Monday afternoon to respond with proof it has been shipped and then open a claim.

The user in question only has 1 transaction, which was as a buyer, but it was positive.

Is that 7 business days or just 7 days? If it's business, then given the holiday and weekends, they have a little more time to get back to me.

Not sure, but even if it was 7 business days I would push it ASAP. There`s no reason why the seller hasn`t contacted you yet, even if he is on holiday.

It's been 9 days now and still no word. I sent him a message 2 days ago asking what was up. I guess it's time to take some action.

It's the holiday season, people sometimes get busier than normal and have family/travel obligations. I wouldn't get too anxious just yet. I've waited a couple of weeks for eBay purchases to arrive. I know that's not the ideal, but jumping to conclusions could make things awkward.

D'oh! This was an error on my part... partly.

For some reason I didn't think about the fact that my paypal address would still be my mom's house, not the house I'm living in. Sure enough I called home and it was delivered on Saturday.

Still, negative feedback for the seller. Zero communication and my item had a little bit of damage to it.

What's the item, and what kind of damage?

it was a derek jeter jersey (christmas gift for my girlfriend). the item was listed as "new" and has the tags on it still. part of the yankee insignia on the front is screwed up and discolored. very noticable. i wouldn't have bought it if i knew (the seller didn't mention anything wrong with the jersey). and it's too much of a hassle to try and fight via paypal/ebay for my money back (the seller doesn't accept returns).

will do, i'll bookmark that site now, thanks mike.

mrpackerguy- if you went to a store, got the worst customer service from the employees, bought, but still bought the product you wanted only to find out it was damaged when you got home and couldn't return it. would you still shop there?

Ok now question.

I left my feedback, and the next day I checked ebay again, and it was gone! It was like I never left it, but when I checked "my Ebay", it said I already left feedback and wouldn't let me leave it again.

Was this an eBay screw up or can a seller find a way to delete negative feedback?

A seller can have negative feedback deleted, but only after talking to eBay and putting their case why it should be removed. In this case the item was delivered in time, so there was one good argument on their side. Also if you didn't file a dispute, then from an eBay point of view that would be another strike.

Can you give us a link to the item so we can see the picture the person provided? He may not have mentioned damage, but if it is visible in the picture it's buyer beware. That's why it's a good idea to always ask the condition of an item if it's not expressly stated in the description. That way you have a message/e-mail to back up any claim.

Also, lack communication if you got the item in time, particularly over a holiday weekend and assuming you got an invoice, for something like a jersey isn't worthy of negative feedback.

Filing a claim isn't a hassle at all on eBay, particularly if you're the buyer and have a case! All burden of 'proof' immediately falls to the seller.

so the seller can send someone a messed up product, not offer returns and then look like they did nothing wrong by deleting feedback? what kind of f'd up system is that?

here is the link to the auction

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=320447716274&ssPageName=STRK:MEWNX:IT

the part that is messed up is on the front on the NY insignia. part of it looks like and extreme amount of pressure was placed on a spot, denting it and discoloring it. the defect is not visible in the picture (or the enlarged version) and when condition says "New" and the tags are still on it, is it unreasonable to think that there's nothing wrong with the product?

i did get a good deal on a slightly defected jersey, but had i know it was defective, i wouldn't have bought it.

i'm contacting eBay as soon as i'm done posting this to see what can be done. for some reason this auction has really pissed me off. i don't want my money back. i don't want to return the jersey. i want the feedback to stand to warn other of a shady seller.
