Eric Perry got busted!!

I just got off the phone with an adjuster from my ins. company. He told me that the other driver's statement to police is quite different than mine. That beeyatch is reporting that I was speeding (her term was "flying") and that I crossed into her lane. Soooo, I called a friend of mine who is a trooper at the same barracks that covered my accident. She tells me that the other driver will be receiving two separate citations and that I will be receiving NONE. According to the unfinished police report, it looks apparent that the covering trooper saw no indications that I was speeding (skid marks, damage to car, etc.), and the skid marks pretty clearly show I never crossed into her lane!

Now.... I'm NOT one for frivolous lawsuits, and generally get angered when I read about them, but I am royally pissed right now. So much so that I am waiting for a return phone call from my lawyer. I don't know why this skank can't just man up and accept responsibility. She was cited at the scene. She must KNOW she's responsible, right??? I'm about ready to defer to my lawyer, and attack this scumbag. :rollno:
 
Ive got some crutches you can borrow.

I can't stand people who can't own up to their actions. Its not like admitting fault is going to put her out all that much, unless she has no insurance.

My first accident, I was hit by a minivan that ran a red light. She told the police that I ran the red light. I was so PO'd! There were no witnesses that stuck around to testify so the insurance stated fault as 50/50. I ended up with far less $ than I was due.

Good on you. That's just asinine of this woman to try to pull the old "switch" routine.
 
sue em'. I got roughly $7500 plus what their insurance paid for my car in my wreck. I promptly blew it, and not on bass stuff (dumb). I was 18.... oh what I would give to have that cash back right now.

also, usually, if there is any question, an accident investigator can come out and determine who's at fault by the skid marks, etc. They physics don't lie.

oh that just totally suuuuuxxxxx!!!!!

but you have the police report on your side. she is not going to get anywhere and her insurance company will see that very quickly.

may i humbly suggest that you give it a little time. her initial reaction is typical, she wants to squirm out of responsibility. she will discover that it won't work and she will come to accept the reality of the situation. be glad she has insurance, they will take care of you.

I know. Like I said, I truly hate diggers in lawsuits and I don't want to become that. If she tries to make any sort of waves, or stands by her (futile) arguments, I AM going to pursue this, however.
