Fender bid gets knocked down!

BTW im wondering if the shapes are intelectual properties of fender why cant they do as the please with them? I mean cant i choose who i want to copy my desings and who doesnt? or even when i want them to copy it or not?

You are losing sight of the facts. If it is your design, and you have exercised control of that design and not allowed it to enter the public domain, then the answer is an affirmative "Yes".

Look at Rickenbacker. They have judiciously filed for tradmarks on all of the designs and protected those designs from day one. Fender opted to NOT trademark the designs, and instead allowed the design to enter the public domain. They had ample opportunity to do so, and opted to not protect any rights to the design.

Once IP has entered the public domain, it will never leave the public domain.

Completely agree with the above part. I left out the other part simply because I do not know Mr. Sadowsky.

I do understand that, what im trying to understand is why there is so many ppl happy that fender lost and some other saying that fender is a greedy company and blah blah... and what really irritates me is that after saying that fender is a greedy company some other ppl try to make look the copycat party as noble guitarmakers, if this whole deal wasnt about money there would have been no trial at all... whoever cant or is not willing to understand that doesnt know what kind of world they are living in.

I don't believe that all of the guitarmakers got into this business for totally altruistic reasons. You never start a for-profit business for totally altruistic reasons.

I do believe that Fender crossed the line in trying to "protect" a trademark several decades after they allowed folks to copy them without protection.

IME fighting fair is the TB equivalent of "I should tie my brain behind my back and ignore what people actually say". We sure wouldn't want people to have to actually say what they meant to say in the first place vs. just talking.

Well if the body styles and scale is the same, it comes down to craftsmanship and electronics really, which is good for the industry as a whole. If Fender won the suit, all the other builders would have to do is make one horn longer, or something like that. The whole thing is silly really.

it's just funny that I've heard that a few times before, usually when a conversation isn't exactly going the other way. I have another one going on where I supposedly said high end basses are always better than anything else, a good fretjob trumps everything and all sorts of goofiness that I couldn't say with a straight face. I also found that my setup and repair skills are lacking and I really don't know how to look at or judge a bass for myself. All this from someone who wouldn't know me from Adam. Must be a nanny cam around here somewhere. Fun stuff.

I voiced an opinion that is based somewhat in fact, and intentionally worded it to be very abrasive, and even flip-flopped a few times to get a reaction from the peanut gallery ...And to see if Mr Sadowsky would pass a little social test. Sorry bout that Mr Sadowsky.:D

I was just seeing how some of the people were kissing his butt so much because he is famous, and wanted to see if I could get Mr Sadowsky to freak out on me for them to see "The Devil in Mr Sadowsky" if you will.

I would definitely question his integrity if I were thinking of buying a Bass from him, but definitely not in the same completely disrespectful way I did in that most heinous post of mine a few pages back. Again, I apologize for that stupid and disrespectful attempt at a social test Mr Sadowsky. Although, in case you care, you passed with flying colors:hyper: ... And I failed miserably instead!:bawl:

Seriously, have you even read the forum rules? You've just admitted to deliberately disrespecting another user for the purposes of upsetting other users and seeing if that user will blow up at you. That sounds a lot like trolling. TB is not here for you to antagonise other users and certainly not ones we are lucky to have participate. Its a courtesy to us that people like Roger S and other lutheirs take the time to post here and share their knowledge and you want to come here to antagonise them? I find that disgusting beyond words.
