And to set the record straight, in terms of headstock decals and distinctive shapes, we are talking about TRADEMARKS NOT PATENTS.
Yes, and trademarks are by far the most egregious of IP laws in terms of violating Ip law intent. The only good thing regarding them is that violation of trademark is purely civil with no criminal component.
...which means they have a lower burden of proof, but have to show actual damages.
Exactly my point, It is not fair, it is not good for society as it was intended and the only ones who defend it are people who unfairly profit from the imbalance.
Thank for reinforcing that Greed is the root of trademarks.

I can tell you that Mike Lull definately does not pay Fender anything, I had the discussion with him about his bass before he started his Thunderbird project because Gibson is well known for going after people too.
I don't understand what IP and copyrights have do to with with this discussion other then confusing it... People know Fender, like Fender, and as it turns out... Some want to pretend it's a Fender.
There are plenty of other basses to chose from. PLENTY. Including ones that look almost exactly like them for a 1/3 of the price and some for a 1/3 of that price. Some just happen to say "Squier" on them and some SX (for example). So... it doesn't seem to have anything to do with whether or not Fender's rich family had sold his intellectual ideas to CBS and who is or is not fighting to keep them.
It has to do with the name being recognizable through years of hard work and others wanting to ride that train without paying full price for the ticket so others can see them waving out the windows of the cool caboose.

Warmoth makes licensed Fender Replacement Necks. So Fender does get some monies from that.
The biggest issue Fender has with J or P inspired basses is to not make a copy of the headstock.
Just recently Fender unsuccessfully attempted to sue Lakland, Sadowsky, Spector and so many more for making Fender style bodies.

Fender is riding that name recognition train too. All Fenders that aren't pre-CBS Fenders are "fake" Fenders...
