i have a feeling a lot of it is dictated by the speed of the server you're connecting to.

which is why in reality this sort of testing becomes useless. It doesn't matter if you're on a university server that will do 90Mb/s or a 1.5Mb/s DSL line, many websites aren't going to be able to send it to you anywhere near your max speed.

Of course if you're downloading something from a server that will deliver at high speed (I just downloaded something from apple.com at 2.5-3Mb/s) then it will make a difference.
 
So after talking to my buddy at our IT service it seems that ISPs are going to be using a new system of some kind (I do not pretend to understand it fully) that will offer the potential for 800Mbps!!!

To fully see the capacity of their networks most providers have taken off the caps on thier speed so the 40,000 Kps speeds just may be correct.

DOWNLOAD ALL THE TORRENTS YOU CAN AND FAST BEFORE THEY CAP THE SPEED AGAIN!!!!!!

Yup. The FCC has already decided that Comcast capping speed for no reason is a no-no. They're considering whether or not to penalize them. Either way, it's a big victory for net neutrality.
