Yup. The FCC has already decided that Comcast capping speed for no reason is a no-no. They're considering whether or not to penalize them. Either way, it's a big victory for net neutrality.

If you have a standard Comcast-issue Motorola Surfboard cable modem, you have always been able to manually remove the cap by hacking the firmware. I have not personally done this, however, since I don't D/L enough to risk breaking the law and/or turning my cable modem into a doorstop if I screw up.
