Besides the cap lead touching the case of the tone pot and the general poor soldering...
1. Small red arrow..it looks like there is a tab coming off the cover of the middle pot at about 12:00 that may be touching the bottom lug on the top pot. This will ground the circuit and cause probs.
2. Large red arrow..this solder joint looks like the lug is making poor contact with the case for ground.
If the suggestions in this thread don't fix it you need to take it to a good tech who can go over it and clean up the wiring/soldering. I have seen worse that worked.
FWIW..I always run case grounds to pots, etc, even if the pocket is sheilded. If a pot loosens up or the part cuts the foil it still works.
