Really Ontario? (silly law content)

As a guy who has been a designated driver many times, isn't it bad enough to clean up puke from the back of your car, break up potential fights, cover for someone's so they don't get in trouble with their SO, making a late night stop at Taco Bell, dragging someone out of your car and placing them someone indoors, but now you can get sued?

If this case becomes a precedent, what next? Additional insurance premiums to cover Designated Driver liability? Drivers bringing in waiver forms for passengers to sign?

And how about cabbies? Since lots of drunk folk take a cab home, are they now gonna be responsible? So will fares increase? Will they go out of business?

Seriously, the person who puts the bottle to their mouth is respsonsible for everything that they do afterwards, even if they say that Jack D or Jim B made them do it. Nothing good can come out of making the sober responsible for the drunk.

Her lawyers – David MacDonald and Adrienne Kirsh – allege in a statement of claim that Ms. Richardson’s partner, Joey Sanayhie, ought to have supervised her copious consumption of alcohol at a party that night and prevented her from harming herself on the way home.

IMO, these guys should be disbarred for taking the case. It's a crying shame that lawyers can take what would be considered otherwise insane and inane and somehow make it set a precedent that would permit inane behavior to persist unchecked.

Youve gone drinking with my girlfriend?

What makes me uneasy is that there is a lawyer who thinks it's a good case and a judge who agrees that it merits a trial. Frivolous lawsuits are eating our society alive.
this was once a nation of independent hard working people....it has morphed into a collection of noisy factions, whining about who should get the next round of government hand outs....
